Senator Stuart Syvret, child abuse whistle-blower, has been arrested

Senator Stuart Syvret has been arrested.

Police picked him up at an address in Grouville at just after nine this morning. He's currently in police custody while investigations continue.

He's helping them with their enquiries into alleged offences committed under the Data Protection Law.

It's believed he could face charges under article 55 - 'unlawfully obtaining documents and unlawfully disclosing them.'

Senator Syvret's lawyers have criticised the police saying their actions were heavy handed. According to Advocate Philip Sinel - the raid involved four police cars and eight officers and was 'clearly designed to intimdate both him and others'.

The lawyers go on to say 'there was no warning in respect of this raid and they are now turning his home inside out. He also suspects that they will take the opportunity to plant covert listening devices.'

Senator Syvret also alleges his arrest is politically motived. And he says if he's not released he'll be making a bail application in the Magistrate's Court.

A TELLY film of the Madeleine McCann drama was halted when the child playing the kidnapped girl collapsed in tears.

She broke down as a TV crew filmed an abductor snatching her.

The child was dressed like the missing youngster in pink pyjamas and a shawl.

The girl, a family friend, started bawling after filming two takes in the freezing midnight air at the holiday apartment in Praia da Luz, Portugal, from which Maddie vanished in 2007, days before her fourth birthday.

The actor playing her abductor tried to calm her by offering her a Pot Noodle but the girl kept crying and film-makers had to halt shooting.

Madeleine’s dad heart consultant Gerry, 40, was watching the on-the-spot reconstruction for the hour-long Channel 4 Cutting Edge documentary, which will be screened on May 7.

He had agreed to make a heart-tugging journey back to the scene of the crime to ensure telly producers got it right.

An onlooker said the scene was chilling. “It must have been almost unbearable for Gerry to watch,” he added.

“The girl playing Madeleine started screaming and crying.

“In the end they took the decision to stop filming after two takes.’’

Hours after the filming, Gerry said prayers for his daughter at the nearby church where he and wife Kate, 41, sought solace when she disappeared.


Poor Gerry - not as "almost unbearable" as it was for the child playing Maddie, though, despite the offer of a Pot Noodle. Perhaps a lolly would have been better.

The false ‘Maddie’ from the new McCann documentary didn’t make the production’s work easy, and on Saturday night refused to cooperate in the filming despite the insistence of her mother and of the other actors.

The little four-year-old girl, who is the daughter of Kate and Gerry McCann’s friends, ended the night of Saturday crying and fighting in her mother’s arms.

Wearing socks and a pyjama that was identical to the one that Madeleine allegedly wore on the night of the disappearance, the little girl, who somewhat resembles the true Maddie, was always in the company of her mother and of the wife of the Anglican priest of Praia da Luz, but not this made it possible for the filming to be concluded, and everything was postponed to yesterday evening, away from the disapproving looks from members of the public who were present on location.

It was at around 11.45 p.m. on Saturday evening that Kate and Gerry McCann’s spokesman ended up apologising to the journalists, saying that it would be impossible to photograph or film the child that evening.

“Can you see that… It’s so cold and the child is standing there wearing socks”, a member of the public protested incredulously, adding that “it had to be English people to do something like that.”

The 40-year-old made the heartbreaking decision as husband Gerry went back to the Portuguese resort for the first time since Madeleine vanished.

Heart surgeon Gerry was heckled by angry villagers who blame the youngster’s disappearance for job losses in the resort after a dip in visitors.

Kate stayed at home with four-year-old twins Sean and Amelie as her husband oversees filming of a reconstruction of the night Madeleine went missing nearly two years ago. A friend said: “Kate is never going to go back. It’s just too hard for her.”

Gerry, who is being trailed by Channel 4 for the documentary, yesterday said prayers for Madeleine, five, at Our Lady of Light church where he and Kate sought solace when she disappeared.

He has also visited the apartment at the Ocean Club resort from where she vanished.

The friend said: “He managed to hold things together but it was still hard for him to be in there.” But some locals turned on the 40-year-old after 21 of the 48 staff were axed at the resort. Bosses claim the number of visitors has fallen since Madeleine disappeared and the recession has made things worse.

One former worker shouted at Gerry: “Go home, leave us alone.” A sacked cleaner said: “We’re fed up with Mr McCann. We want him to disappear for good from this place.”

Gerry McCann yesterday made an emotional trip back to the Algarve holiday apartment where daughter Madeleine vanished two years ago.

The father of three looked distraught as he let himself into apartment 5A to help work on a TV reconstruction of her disappearance.

For the first time since she disappeared, Gerry, 40, from Rothley, Leics, spent an hour inside the bedroom where Madeleine had slept with twins Sean and Amelie, now four.

He then retraced the few painful steps between the flat and the tapas bar where he and wife Kate enjoyed a meal with friends on the night Madeleine vanished.

The trip came after Gerry and Kate agreed to let a Channel 4 documentary film crew record a reconstruction of their last night with their daughter in a fresh bid to find her. His return to Praia da Luz was the first since he left Portugal after Madeleine vanished on May 3, 2007 – and only his second visit to the country since he and Kate were cleared of any involve- ment in her disappearance last July.

It is also a year since the McCanns and the “Tapas Nine” group of friends on their holiday declined a request to take part in a Portuguese police reconstruction.

The daughter of a family friend will play Madeleine in the drama-documentary by director Emma Loach – daughter of award-winning director Ken Loach – to be screened on Channel 4 on May 7.

Actors will play the parts of Gerry, his wife and the rest of the Tapas Nine.

Kate decided against returning to Portugal for the reconstruction, but two of the Nine – Jane Tanner and Matthew Oldfield – made the trip to help Gerry.

The McCann’s spokesman Clarence Mitchell said: “There are new elements in it that may generate that important piece of information that could lead to Madeleine being found.

Gerry will stop at nothing to find Madeleine or at least discover what happened to her in that flat, no matter how difficult and painful it is.”

Gerry McCann, accompanied by Clarence Mitchell and by his friends Jane Turner and Matthew Oldfield, two members of the Tapas group, were in Praia da Luz yesterday to follow the first day of filming of a new television documentary where the English production team didn’t hesitate to use the services of a child to play Maddie’s role.

Maddie’s father arrived at the Ocean Club in the company of Jane Tanner and returned to the same locations that the group of English people frequented when the little girl disappeared, having inspected the Tapas Bar, the tennis court and even apartment 5A, where cots just like the ones in which Sean and Amelie slept on the night of May 3, were brought in.

The documentary, in which 15 actors participate, intends to reconstruct the McCanns’ version of an abduction that allegedly took place at around 9.30 p.m. on the evening of the 3rd of May 2007, and which gives the idea that the man who was seen by Jane Tanner, was the perpetrator.

In the presence of several members of the GNR [local police force], who were sent on location to guarantee the safety of the group of English citizens, the production team from Mentorn Media filmed inside and outside of the Ocean Club, including in the apartment where Madeleine was allegedly abducted from.

That documentary, which “is going to be centred on leads that were undervalued by the Portuguese police”, may be broadcast in Portugal by SIC [tv channel], with which conditions are to be negotiated that may include a “contribution” to the financial fund that was created by the McCanns in 2007, a fact that Clarence Mitchell, the couple’s spokesman, denied to 24horas: “there won’t be any contribution to the ‘Find Madeleine’ fund or even to the family. The parents simply want to find further leads that help the private investigation to find Madeleine McCann, nothing else”.

The members of the public that were present around the entry to the resort’s reception didn’t enjoy the presence of the English group, accusing Gerry McCann of carrying out “burnt land” politics in Praia da Luz: “Two years later, what do they want to prove?”, a member of the public asked, stressing that it was incomprehensible that the Portuguese authorities permitted “to carry out this circus in a village that hasn’t stopped suffering with this case yet”.

According to the filming – that doesn’t match the statements that were made by the nine English citizens when they were questioned in Portugal and in the United Kingdom – the documentary now intends to transmit the idea of a predator in Praia da Luz, who allegedly watched the group’s steps, the reason why the filming includes the dinner at the Millennium restaurant, where the couple dined on the evening before the little girl’s disappearance, near the Ocean Club swimming pool, and near the church of Praia da Luz.

Private investigations continue

Just like 24horas had reported yesterday, the McCann couple’s spokesman confirmed to journalists that two private investigators are in Praia da Luz working on still unexplored leads, without specifying any further.

The two men were even observed in terrains not too far from the Ocean Club, where they inspected a cane field under the attentive look of members of the PJ.

During the filming, which continues today (Sunday), those investigators will observe the reconstitution of the case “according to the description that was given by Gerry and his friends”, which according to the couple’s spokesman, “may help to understand where Madeleine went to”.

Among various key scenes of this documentary, large emphasis is placed on the witness testimony of Jane Tanner, who states that she observed a man carrying a child, but which she was incapable, since the outset of the official inquiry, to describe in a coherent manner.

When questioned by 24horas, Clarence justified the decision by the couple and their friends not to participate in the reconstitution that was requested by the Polícia Judiciária, explaining the fact that by not being broadcast on television, it couldn’t help the McCanns.

“Now we believe that this documentary may generate new information that help us to find Madeleine”, Clarence Mitchell added, explaining that after being negotiated with several countries – including Portugal – the video will be available on the webpage that was created by the couple: www.findmadeleine.com.

During the course of the filming, the GNR will keep teams on location to maintain the tranquillity of the film crew’s work and to keep the population away, which is openly unhappy about Gerry McCann’s presence.

McCanns may return by the end of the month

A source close to the couple confirmed once more that Gerry McCann and some relatives may return to our country as early as the end of April in order to be in Praia da Luz in time for the second anniversary of Maddie’s disappearance, but that “Kate is not prepared yet” to face a return to our country, which was confirmed by Clarence Mitchell.

Priest doesn’t want the McCanns in church

Father Pacheco has informed Gerry McCann that he doesn’t want him in the little church of Praia da Luz this Sunday, neither him nor any of his friends.

On the day that Gerry McCann arrived in Portugal to record the private reconstitution about what happened to his daughter Maddie on the 3rd of May 2007, 21 workers from the Ocean Club, the resort where the little four year old girl disappeared from, were dismissed. The justification, apart from the global crisis’ effects: “As a result of the unfortunate Maddie McCann event”, which has forever damaged the image of the resort in Praia da Luz and sent tourism away.

On the side of these problems, and despite the fact that neither he nor his group of friends collaborated with the police in a reconstitution of what happened that night, it was a smiling Gerry who presented himself in Praia da Luz yesterday – to record a documentary about the day when he mysteriously lost his daughter.

On the day that this media show took place, Greentrust, the company that runs the resort, advanced a collective dismissal action, which in a first phase includes 21 of the 48 Algarvian employees. The dismissal note mentions that the company’s financial problems are serious and “the perspectives for 2009 render the firm inviable”. The main fault is placed on the bad publicity that has been caused by the Maddie case. According to the firm, “the bad results of 2007 were caused by the abovementioned McCann case”.

In May 2007, the firm had 130 employees. During the following year, several were discharged and only 60 remained. This year 48 has been left, and after the most recent collective dismissal, 27 are left, who “are also at risk”, according to a source at the firm.

“I have a family and children to raise and now I’m out of work. We ask this McCann couple to leave us at peace, please”, one of the workers told Correio da Manhã.

Daughter of McCanns’ friends plays Madeleine

The reconstitution, which is being produced for British ‘Channel 4’, is being recorded with 15 actors. One of them represents Maddie, whose role will be played by “a child from a couple that is friends with Gerry and Kate”, Clarence Mitchell, the couple’s spokesman, revealed to the journalists.

Apart from Maddie, the rest of the cast plays the nine couple’s friends, known as ‘Tapas 9’, and an alleged abduction suspect, tourists and residents of Praia da Luz, and Ocean Club employees.

“Let us live in peace”

“Go home” and “let us live in peace” were some of the sentences that some residents of Praia da Luz shouted at Gerry and the team that is producing the documentary, which will be broadcast worldwide. “What are they doing here? They didn’t help the police when they should have, and now they put on this show to ruin our lives even further”, an upset resident who didn’t wish to be identified told Correio da Manhã, fearing reprisals, because she realises that the couple “is very powerful”.

The Polícia Judiciária tried twice to carry out a reconstitution of the night of the disappearance, but at no time did the couple and its friends show themselves available. Clarence Mitchell, the couple’s spokesman, justified that the reconstitution was not made at an earlier time because back then “the police refused to broadcast it on television”.

Now that the investigation process has been archived, the couple believes: “This documentary may generate new information to help find Madeleine”, Mitchell referred.

The reconstitution will be available on the www.findmadeleine website, while the Channel 4 documentary is being negotiated with several European countries, including Portugal.

Kate and Gerry McCann are set to take part in an ITV documentary marking the first anniversary of their daughter Madeleine's disappearance.

The programme will feature extended contributions from the parents and focus on the campaign to prevent others going through a similar ordeal. It is the only TV programme the McCanns have agreed to be filmed for in the run up to the anniversary.

The documentary team has followed Kate and Gerry McCann since early January and exclusive footage for the one-hour special will include the couple in their home in Rothley and travelling around the world.

They also talk about Madeleine, the night she went missing, becoming “Arguido” suspects in Portugal and the decision to return to Britain.

Kate and Gerry campaign to introduce to Europe a USA-style Amber Alert system, in which law enforcement agencies are empowered to commandeer airtime on TV and radio when a child goes missing. The system also includes alerts via email, electronic traffic signs and text message.

The McCanns hope a European-wide scheme will help reduce the chances of their experience happening to other families.

ITV’s controller of current affairs and documentaries, Jeff Anderson, said the channel will donate £10,000 to the Find Madeleine Fund. However, he added that no payment has been made to Kate and Gerry McCann for the making of the programme.

Steve Anderson, executive producer at Mentorn Media, said: “Amid all of the controversy, what should be remembered is that a little girl is still missing and her family is trying its best to find her.

“We have been with Kate and Gerry McCann as they have pushed for a better system across Europe to help stop child abduction. They are determined to do whatever they can to make sure that what happened to Madeleine doesn’t happen to another child.

“They also speak frankly and honestly about Madeleine’s disappearance which is undoubtedly one of the biggest stories of the past 12 months.”

McCann New Documentary: Gerry McCann in Portugal

According to Sic News Channel, Gerry McCann arrived today at Lisbon in the company of some British reporters and an ITV production team to shoot a documentary in Praia da Luz, Algarve.

Apparently the ITV documentary will comprise of a reconstitution of the events of 3rd of May, the night Madeleine McCann disappeared, sources confirm that Kate and Gerry McCann and the other members of the Tapas group will be represented by actors playing their roles.

Kate McCann and the other Tapas members were not seen in Lisbon.

The sad reality is that this 'televised' reconstitution will not help to understand what happened to Madeleine since all statements given by the McCann Couple and their friends are full of incongruences and contradictions regarding the time-lines, a clear attempt from their part to mislead the Portuguese Judiciary Police investigation.

One has to wonder why none of the persons directly involved in the night that Maddie disappeared accepted to do a criminal reconstitution as asked several times by the Portuguese authorities.

If Mr. McCann and his wife are so keen in knowing what happened to their missing daughter they should, within their rights, ask the Public Ministry to reopen the archived process. And maybe, finally answer all the questions made by the Judiciary Police.

What we see here, with this documentary, is just another attempt to make money for a bottomless fund from a little girl's tragedy.

A month before the second anniversary of Madeleine’s disappearance, Gerry McCann, the little English girl’s father, arrived yesterday evening at Lisbon airport for a 48-hour visit.

During his stay, Gerry McCann will follow the filming of a “kind of” mini reconstitution of what allegedly happened on the night that Maddie disappeared. The filming is made by ITV, that intends to record a documentary and counts on a group of actors who will play the roles of the nine British citizens: Kate, Gerry McCann and the other members of the Tapas group.

According to the couple’s spokesman, Clarence Mitchell, Madeleine’s father allegedly also comes to follow the couple’s ongoing private investigations on the terrain.

“Gerry is not going to meet the PJ or any member of the Portuguese authorities”, Clarence told 24horas.

The couple’s spokesman, now also working for a communications and public relations company, further promised that during Gerry’s visit to Praia da Luz, the media would be offered “relevant news” concerning the search for Maddie.

Clarence Mitchell refused to confirm or deny the presence of private investigators in Praia da Luz, but 24horas knows that during last week, while the campaign was ongoing, at least two former members of the English police visited the locations where supposedly Maddie was abducted from.

As 24horas had published already, Gerry McCann returned to Portugal alone because “Kate is not ready yet”.

Yesterday evening, Maddie’s father travelled directly to the Algarve, after being greeted by members of the British embassy, who awaited him on his arrival.

Clarence Mitchell confirmed to 24horas that “just like Gerry had announced a few weeks ago, during his first visit, this is just one more visit”, and other visits are scheduled, with “the purpose of searching for Maddie”, according to the couple’s spokesman.

PJ follows Gerry’s visit to the Algarve

A source at the Polícia Judiciária in Portimão confirmed that Maddie’s father’s visit to our country is being watched closely, yet lamented that the couple didn’t carry it out at “the time when the inquiry demanded it”.

The population of Praia da Luz, which is upset by the campaign that has been carried out in that area of the Algarve, fails to understand the visit’s purpose: “They did nothing to help the police and ended up fleeing this place like criminals”, Rui Macedo told 24horas, adding that “they won’t rest until they destroy our region”.

But Gerry McCann isn’t the only one returning to Portugal, as 24horas was able to establish that several other persons who intervened in the Maddie case are in our country at the moment.

Missing Madeleine and a reluctance to help

I hear of more anti-Madeleine protests in Praia da Luz, where the McCanns have launched a renewed campaign for information about their daughter's disappearance.

A billboard on the edge of the town has been daubed with paint and flyers handed to locals have been ripped up, according to my man on the Algarve.

He tells me traders are struggling to cope with a drop in tourism, the low pound and a lingering stigma of Luz as an unsafe place to take kids.

"People are driving into Luz, seeing the posters and thinking 'Oh God, it's that place and then driving straight out again," he says. "We've done a lot to help, but what more do they expect from us?"

The marketing campaign is being run by a design consultancy and aimed at the Portuguese community which, it says, was never properly questioned at the time Madeleine vanished.

Bit late in the day for that.

But, two years on, what would you do? The key to the mystery must lie in Luz.

In my book: “What Really Happened to Madeleine McCann?” - which last week was sent to all the U.K.’s 646 Members of Parliament, thanks to donations from the general public - I gave 60 separate reasons which suggest that Madeleine was not abducted. Many people have contacted me to thank me for writing the book. Some of them have told me what, in their opinion, are the strongest reasons. I’m going to pick out the five reasons which most convince people that Madeleine was not abducted.

I start with the evidence of two of the highly trained spaniels who were brought to Portugal to see if they could detect the presence of a corpse in the McCanns’ apartment or the Renault Scenic car they hired. These dogs were trained by Mr Martin Grime, an experienced dog handler whose services are in demand from many countries and not just in the U.K. The male dog, Eddie, was trained only to bark when he smelled the scent of a human corpse. The female dog, Keela, was trained to detect blood.

I will focus on what Eddie detected. His handler says that on 200 previous occasions, Eddie had never once given a ‘false alert’. That is, when he barked, he was 100% correct in locating where a corpse had been lying. If he barked anywhere in Praia da Luz, we can therefore be sure that he was alerting to a corpse.

So, where did he bark? First, in four places at the McCanns’ apartment - their living room, the McCanns’ bedroom, the veranda, and in the garden.

Second, on two of Dr Kate McCann’s clothes. Third, on a red T-shirt belonging to Madeleine or her brother Sean. Fourth, on the pink soft toy, ‘Cuddle Cat’, and fifth, inside the Renault Scenic and on its key. Keela, of course, also found blood at some of these locations.

Eddie was taken to many other houses and apartments in Praia da Luz, and to many other cars. He only barked in the McCanns’ apartment and at the car the McCanns hired. No other corpse had been in the McCanns’ apartment or in their car. It’s very sad to have to say it, but that corpse could only have been that of Madeleine McCann.

Now let us move on to consider how the McCanns reacted when they first heard the reports of the dogs’ findings. Did they try to find out who might have been dead in their apartment or their car? No, they immediately began a campaign to discredit these highly trained, successful dogs. As I demonstrate in ‘Reason 3’ in my book, they came up with a series of claims to try and make it look as though Eddie and Keela had been ‘mistaken’.

First, Dr Kate McCann’s family spokesman claimed the ‘smell of death’ may have been found on her clothes because she had been in close proximity with six corpses in the two weeks before flying out to Praia da Luz. But she only worked 1½ days a week, and even if she had been called to six deaths in two weeks (which the McCanns have never substantiated), the smell of death would never have been transferred to her clothes. Doctors rarely even touch a dead body with their hands, certainly not with their clothes.

Then Dr Kate McCann claimed that the smell of death was found on ‘Cuddle Cat’ because she sometimes took the soft toy to work. Even if we believe her, does she seriously expect us to believe that the toy itself was in contact with one or more corpses?


The McCanns then said that body fluids found in their car could be caused by dirty nappies - and the smell of a corpse caused by ‘rotting meat’. But cadaver dogs like Eddie can tell the difference between the smell of a corpse and rotting meat. When it was suggested that Madeleine’s blood might have been found underneath the tiles in the living room of Apartment 5A, the McCanns explained this by saying that Madeleine had grazed her knee when climbing up the steps to the plane on the flight to Portugal. It is wholly improbable, however, that a graze on the knee could cause enough loss of blood to seep under the ceramic tiles in the McCanns’ apartment.

In addition, the McCanns and their advisers searched high and low for any evidence that courts had discredited the evidence of cadaver dogs. They eventually found just two - one in Ireland and one in the U.S.

‘Reason 7’ in my book refers to the sheer impossibility of the abduction happening as the McCanns and their friends claimed. According to them, the abductor must have entered the flat after Dr Gerald McCann did his check on the children at 9.10pm on 3rd May - but before he was (allegedly) seen by the McCanns’ friend Jane Tanner at 9.15pm walking away from the apartments.

He would then have had to enter the apartment by the unlocked patio door without being seen by anyone, found Madeleine in the dark, pick her up without waking her or the twins, opened the window and the noisy shutters without leaving any fingerprints, climbed through the window (carrying Madeleine with him) - again without being seen by anyone - and then tried to close the shutters, using controls operated from the inside, while still having Madeleine in his arms, or having laid her down on the patio. In addition, he must have accomplished all this without leaving any forensic trace whatsoever and without being seen or heard by anybody. Most people who have read my book do not accept that this is possible.

For many people, the fact that Dr Kate McCann was asked 48 questions by the Portuguese police on 7th September 2007 and refused to answer any of them was very significant. No-one can understand why a genuinely grieving mother who believed her child had been abducted would refuse to answer questions and give the police every possible assistance.

Finally, I turn to ‘Reason 29’ in my book, which many people, especially women, have told me is very important for them - namely, the body language of the McCanns. Now, I know this would not count as evidence in a court case, but in assessing evidence given inside a court-room, judges and juries often rely on visual clues from those giving evidence to help them decide whether they are telling the truth or not. And do we not use this ability to read body language all the time? - for example, to decide if our wife or husband is telling the truth, to assess if people are interested in what we are saying to them, and so on?

These are some of the things that people observed about the McCanns: looking remarkably cheerful so soon after Madeleine had gone missing, avoiding eye contact with interviewers, turning their heads away from the interviewer when difficult subjects were raised, smirking at inappropriate moments, never showing any real signs of distress, and body and facial gestures not matching their verbal statements.

These five reasons alone have convinced many that the McCanns are not telling us the truth - and that Madeleine was not abducted. But there are 55 more reasons in my book.
