Amaral's book causes the McCanns torment and anguish, yet Maddie being 'abducted by a paedophile' only causes them pain and sadness

At the start of August this year, our investigators appealedto the general public for more information following a credible account by a witness. This related to a lady acting suspiciously in Barcelona on the 7th May 2007 in the early hours of the morning. Our investigators received approximately 1000 emails and phone calls following this appeal and have been busy working through this information.* Thank you to everybody who passed information on to our team.We would like to encourage anyone who may still have potentially relevant information to come forward. It is important to note that although the witness thought that the woman in question may have had an Australian accent, it ispossible that this may not be the case.

At the end of August, we learnt of the discovery of JayceeLee Dugard, 28 years after she was abducted at the age of 11. There was nothing new here for Gerry and me, as we have been told of many cases of missing children who have been found years after they were taken from their families. It is important though, as it emphasises yet again how vital it is to never give up on missing children and how criminal and unjust to assume they are no longer alive. A missing child cannot be expected to find their way home, we need to find them. It is tragic and heartbreaking to think of the life which has been stolen from Jaycee and her family. We hope and pray that they will be able now to find the happiness and peace that they all deserve.

Last week, a judge in Portugal decided to pass an injunction against Goncalo Amaral's book and documentary in which he insists that Madeleine is dead and implies that Gerry and I were somehow involved in her disappearance. Nothing can be more soul-destroying for a parent than for somebody to ‘write off' your missing child (for whatever reason) without any evidence to support such a theory. The anguish and torment that we have suffered as a result of Mr. Amaral's unfounded claims and actions has been immense, compounding the pain and sadness we feel every day without Madeleinein our lives. Madeleine deserves so much more than treatment like this. She is still missing and we will never give upon her.

" We are pleased with the Judge's decision today preventing further distribution and sale of Mr Amaral's book and dvd -'The Truth of the Lie'.

Mr. Amaral's central thesis has no evidence whatsoever to support it. To claim as he did, that Madeleine is dead, and that we, her parents, were in some way involved with her disappearance, has caused our family incredible distress and it continues to do so.

Without doubt, Madeleine will have suffered as a result of the negative effect this book and dvd will have had on the search for her.

Sean and Amelie need protection too from such awful claims.

Hopefully this injunction today will go a long way towards reducing further unnecessary and unjust distress to us all and allow people to concentrate completely on what is important - finding Madeleine."

It is the first time they have publicly expressed their fear.

Facts from the DVD Process

- According to a preliminary, not final report, made by the Forensic Science Service (FSS) of Birmingham, England, this cellular material belongs to MADELEINE.

- Besides the cadaver scent dog strongly alerted to the room where the McCann couple used to sleep.

- There was also a new strong cadaver scent alert given on KATE's clothes.

- There was also a strong cadaver scent alert in the car used by the couple (since May 27th, 2007), along with the human blood detecting dog's alert to the luggage compartment of that vehicle.

- The before mentioned FSS's Interim Report indicated that there are, resulting from the examinations made to the luggage compartment, biological components that may be compatible with the ones of the minor ; however, this test does not definitely show that the traces originated in MADELEINE's body.

- The cadaver scent dog, as well as the human blood detecting dog, also gave Alert to the key of the before mentioned vehicle. The Laboratory also confirmed the existence of GERALD McCANN's DNA in the key. Furthermore, this last Alert was given by the dog's when the key was placed away from the vehicle and in a place out of sight.

• Forensic examinations are being carried out to the places and objects marked by the human blood scent dog and to which this dog gave alert.

• Based on the performance of the dog team, revealing the possibility of the presence of a body in the apartment and in the vehicle used by the MCCANN family, and in order to give GERALD MCCANN and KATE HEALY the chance to have their position in the proceedings safeguarded, they were named arguidos [formal suspects], merely due to the possibility of their involvements with a possible cadaver.

-The information gathered at the beginning with the family and friends – a GROUP made up of a total of nine adult persons – reveals some disparities and shows that it is necessary to determine with certainty the precise way these facts have occurred.

-According to the parents and to the other members of the GROUP’s account, they went to have dinner, all of them leaving their children, sleeping, in their own apartments.

-We are aware that, “a posteriori”, they got together in a meeting where they remembered the rules referring to the continuous supervision of the children while they were having dinner.(....)

Following the analysis made to the information obtained from the statements, one of the members of the GROUP, JANE TANNER, became very important due to the information she gave: she saw someone, at dinner time, around 09.15 p.m., crossing the street that provides access to the main entrance of the apartment towards ROBERT MURAT's house, carrying a child.(...)

- We can also perceive hte lack of a consistent version about the alleged sighting of the man carrying the child in what concerns GERALD MCCANN and JANE TANNER's statements, as well as in what concerns JEREMY WILKIN's witness statement, who was in that place, at the mentioned date and time.

- Even the place where, allegedly, they would have passed by each other is not very well explained by none of them.

- Since there was an Alert given by the two dogs (dead body scent/blood), behind the sofa of the living room, it was possible to consider that MADELEINE McCANN's dead body may have been in that place, which originated the gathering of material to be subject to biological examination.(...)

Subject: Disappearance of Madeleine McCann

During the course of the ongoing investigation, various personal contacts were made by the undersigned with Kate and Gerald McCann, within my task of serving as communication element between the police and the McCann couple.

Within this context, the undersigned was present during various “strange“ behaviours by the couple, who gradually began to react in a very negative manner to the increased investigative activity carried out by this police force, especially during the use of the English sniffer dogs for detecting cadaver odour, when more evidence arose in the investigation for the hypothesis of the death of Madeleine McCann.

Several times, the McCann couple said that the attention of the police should be maintained focussing on the abduction hypothesis, which, in the couple’s opinion, was the only scenario that occurred and that the police should not forget to continue to investigate the suspect Robert Murat.

Strangely, Kate also made several requests, three months after the disappearance of Madeleine, that the police should take blood, hair and nail tests of Madeleine’s twin siblings, because, as she said, she remembered that on the day of Madeleine’s disappearance, in spite of all the commotion and noise made by the authorities and other persons who were looking for Madeleine in apartment 5ª of the OC, the twins never woke up, having been transported to another apartment, they remained asleep, due to which she now presumes that they were under the effect of some sedative drug that a presumed abductor had administered to the three children in order to be able to abduct Madeleine, a situation which Kate refers to being possible according to what she read in a criminal investigation manual given to her by the British authorities, that would have been the procedure of the abductor in the real case involving abduction, rape and murder of the girl.

Today, when the undersigned went to the McCann’s temporary residence to notify them of the need to present themselves at the police station to make statements, being able to take their lawyer with them, Kate McCann immediately reacted in a negative manner, making comments such as “what are my parents going to think” and “what is the press going to say when they find out” and that “the Portuguese police is under pressure from the government to finish the investigation quickly”.

With regard to Gerald McCann, he constantly insisted in giving the undersigned letters and emails that he was receiving, mostly from psychics and mediums, whom he had selected and which mainly contained information without much credibility about the possible whereabouts of Madeleine and her presumed abductor.

More recently, and even before Kate’s interrogation, during a telephone call between Gerald McCann and the undersigned, he made a reference regarding the investigation, that he was certain that the police did not have any proof that could incriminate them with regard to the death of Madeleine McCann and he said that the police were wasting their time in directing the investigation around the parents.

Gonçalo Amaral’s lawyer “deplores” that someone wants to prohibit the book’s sale

The lawyer for former PJ inspector Gonçalo Amaral said today that he “deplores” as a citizen that the selling of the book about the disappearance of Madeleine McCann was prohibited, which will limit the “freedom of expression” in Portugal.

In statements to Lusa agency, António Cabrita said that he has not been notified about the decision concerning the injunction that forbids the sale of the book “The Truth about the Lie” yet, and he doesn’t wish to take a juridical position about the matter without previously speaking with his client, Gonçalo Amaral.

Nevertheless, he observed that, if the decision’s tenor, as divulged by the media, is confirmed, then it is the “freedom of expression” that may be being limited, because the book about the disappearance of the English child in the Algarve emits an opinion about “certain facts” that took place.

Gonçalo Amaral’s lawyer said it was “strange” that, with the book having been published over a year ago, an injunction has been served only now in order to forbid the book, when the book’s sales have “already attained their peak”.

“As a citizen, this worries me”, António Cabrita commented, further noting that this measure appears at a time when the possibility of translating the book and an eventual interest in selling it in the United Kingdom were being mentioned. “If this is true, then it’s possible that this reaction is related to that”, the lawyer admitted, adding, nevertheless, that he “deplores” what is happening.

Among other statements that are related to the prohibition of the book about the investigation into the English girl’s disappearance, António Cabrita stressed that “it was not Gonçalo Amaral’s pituitary that was sniffing the cadaver odour”.

Contacted by Lusa, Gonçalo Amaral declined any comment, referring all questions to his lawyer.

The Civil Court of Lisbon has forbidden the sale of the book “The Truth about the Lie”, about the disappearance of Madeleine McCann, by former Polícia Judiciária inspector Gonçalo Amaral, and has ordered the removal of any copies that are available on the market.

The court’s decision, which was accessed by Lusa today, is the result of an injunction that was filed against the former inspector and the editors, in order to impede the continuation of the divulgation of the book and the video that is based on it, as well as the theories that are presented within them, which point towards an involvement of the parents in the child’s disappearance. The action has been served by Kate and Gerry McCann together with their three children, Madeleine, Sean and Amelie, who are represented by lawyer Isabel Duarte.

The English girl Madeleine McCann disappeared on the 3rd of May 2007, when she was aged three, from the bedroom in an apartment at a resort in Praia da Luz, near Lagos, in the Algarve, where she was on vacation with her parents and her two siblings. The parents were made arguidos in September 2007 but cleared in July 2008 over a lack of evidence.

Since the beginning, the family has maintained the position that Madeleine was abducted, but until this day the authorities have not been able to find out what really happened, and the Public Ministry archived the case, which may be reopened if new data about the disappearance of Madeleine emerges.

Kate McCann has become very solitary. The twins, Four-year old Sean and Amelie, are her favourite company now. She leaves the house just for them, Flash! was told by a source close to the family in Rothley, England, home of the parents of the missing child, who disappeared in the Algarve on May 3, 2007. Two years on, this fateful date coincides with Mother's Day. "I never again saw Kate's true smile. Two years later and she's still very reticent about leaving the house. She only goes out to visit the hairdresser and to take the twins to school or elsewhere. She goes to the hairdresser while her children are swimming, says the source 'phoning from Rothley.

The life of Maddie's mother now consists of little else; that and going out jogging once in a while. Kate has changed a good deal since her daughter's disappearance. She's stopped work as a doctor and dedicates herself to her children. Gerry has gone back to work. "He's much busier than she is. He goes to work by bicycle and comes home late," says the same source. He resumed activities. As for the isolation of Kate "It's dividing them more and more." "It's obvious their marriage has suffered with all of this," emphasising that they appear closer to each other when they are with the twins. Besides, "Amelie looks more like Maddie every day." The twins are now the same age as Maddie was when she disappeared.

Kate's mother told Flash! that her daughter and son-in-law are fond of each other despite everything: "Gerry and Kate are very good friends. They care for each other and suffer together. They continue life together for Sean and Amelie's future happiness."

Even the Rothley community has distanced itself from the pair, just like the people of Luz. "When they go to Mass, some of the older folk continue to offer support, but generally the town's population is colder towards them." Nowadays the McCanns are not a part of the area's social scene, unlike before. "They are insular." According to the source the residents are tired of the media, that's why they distance themselves. At most the house is visited by close family and three others "of the group of nine friends (seven friends) who were with them in the Algarve when Maddie disappeared, that is David and Fiona Payne and Jane Tanner, as they are connected with them."

"Kate never did intend to commit suicide"

Lacking support from the community and friends, the former involvement of Gerry and without her daughter Madeleine, Kate feels very much alone. "It is noticeable that Gerry feels rather better than she does about things." And yet, "she never attempted suicide" as was claimed. Both the source and Kate's own mother Susan Healy have told the magazine that. "That's absurd. You cannot begin to imagine what it takes for me to respond to that. My daughter has gone through a lot these two years past. Living's not easy when you don't know where your daughter is, my granddaughter Madeleine, but she would never attempt suicide. She loves Sean and Amelie. They're her reason for living," said Kate's furious mother. Once calm, albeit still preoccupied for her daughter, Susan Healy continues: "I cannot say things are good. I lost my daughter at the same time as I lost my granddaughter that wretched night two years ago. I shudder to think of it, the more so when it's said she's tried to kill herself."

Nor does another source close to the family believe it: "She didn't manage to return to work, to her normal life. She's obviously depressed, but I don't believe she would attempt suicide. She's a rational mother above all who would always think of Sean and Amelie, even in those darkest moments." According to this female friend, Kate has also cut down on her own medication. "She's already given up anti-depressants. Now she takes something with the same benefit but gentler. Despite everything she's gained a little weight and is concerned to look good when she leaves the house." As to the forthcoming date of 3 May, husband and wife are most likely to remain in England with the family. Anyway, for Kate, "Returning to Portugal's unthinkable at the minute. I can't." More self-assured, Gerry McCann has returned twice already to our country. As he often emphasised, he and Kate are determined to find their daughter Madeleine, now six years old.

Yet the population of world are supposed to believe that the whole of Rothley were outraged by the recent leaflets posted by the MF and how these leaflets caused upset to the McC's!

I notice only the Payn"s and Jane Tanner keep in touch, no mention of O"Brien who did not attend the Court proceedings in the libel suit against the DE, nor did he attend the recon in Portugal., I wonder why???

I think this is sad in a way,all it needed was the truth to be told from the begining,and although their lives will never be the same again,maybe they could after a while look each other in the eye.As it is they are in this prison of their own making.

It also has to be remembered that Madeleine wasnt the only child to be left alone in that apartment night after night. The twins were there too. They were already being neglected by their parents - the damage was already being done.

Imo the biggest critics will be their own children when they grow up. This will not be swept under the internet carpet as some would like. This information will be available for all who choose to educate themselves.

I, too, worry about the twins' welfare. Especially when I hear about them playing "Hunt The Monster Who Took Maddie", talking to her on a toy phone, and being forced to paint her name for the cameras.

How many more innocent 'Maddie look-a-like' children are going to be put at risk while the McCanns carry on with the smokescreen of their staged, fake abduction? Is it only a matter of time before a 'Maddie look-alike' child is snatched in a mistaken 'rescue' attempt by a gullible member of the public who hasn't seen the video of the dogs alerting to blood and cadaver in the McCann's apartment and car they hired more than 20 days after Maddie 'disappeared'? For goodness sake, McCanns, if you truly believe Maddie is still alive why on earth won't you demand the investigation is reopened so that the real police can find her before another child is traumatised by this farce?

Whilst in Benissa, I met with an English fellow journalist who was very much impressed with the latest revelations about the disappearance of the British toddler Madeleine McCann on May 3, 2007 in the Portuguese village of Luz.

"How is it possible that the parents, Gerry and Kate, can get away with this?," he said, incensed, after which we evaluated together all the events once more.

We did this with Gonçalo Amaral's tell-it-all book at hand; as chief inspector he was closely involved in the case in 2007. He was dismissed from the case because the Portuguese policeman had told an English journalist that a tip, which had been sent to the Royal Family, could not be taken seriously; in that the English police should follow the line of the investigation, viz. looking for a corpse, and should no longer consider abduction.

The tip was a futility compared to the long-lasting inquiry, but obviously political interests had become so important that Gonçalo Amaral had to be removed from the investigation. Out of spite and disappointment he then wrote the book: "Maddie, The Truth About The Lie".

Impressive

As an investigative journalist I can only conclude that it is an impressive story. The chief inspector tells it all and publishes tens of investigation details. How much better can a journalist have it dished up?

His conclusions are shocking. A dog, specially trained for cadaver scent, barks loudly at a cupboard in the parents' bedroom and behind the sofa in the living of the apartment.

Another dog found traces of blood in the apartment and in the back seat of the parents' car. DNA tests then concluded that there was a sixty percent chance that this originated from Maddie McCann. Also, for that matter, the cadaver-scent dog also barked at the parents' car, mother Kate's clothes, Maddie's cuddle toy and the car key.

Witnesses

My English colleague and I are flabbergasted. Amaral also spills it all regarding the witnesses statements. In the Montemar hotel, where I was staying for the past few weeks, we had ourselves come to the conclusion that the statements of the group of doctors – the McCanns travelled with a number of friends – gave a rather disjointed account of events.

There was also the statement of the Smith family who saw a man carrying a child in his arms on the so-called Rua da Escola Premaria. When they saw Gerry McCann on television, as he walked down the airplane stairs, they recognised the father immediately as the man who walked the streets with that child in his arms.

Questions

Eventually they did interrogate the parents, but at first there were no clear answers to all of those questions. The moment that Gerry and Kate McCann were going to be further questioned about the many unanswered questions regarding their possible involvement, they left for England.

Meanwhile a fund has been created where millions were donated to trace Maddie and there was a nearly worldwide call to trace the toddler. According to Amaral, Gerry and Kate McCann have never given a clear answer to the findings of the investigation.

At any rate Amaral's conclusion is that Maddie McCann died on May 3, 2007 in the apartment 5A of the Ocean Club in Portuguese Luz and that an abduction has been staged. Another conclusion is that Gerry and Kate McCann should be suspected of being involved in the hiding of the little corpse.

Amaral also mentions that her death could be the result of a tragic accident and that there are many signs, which point to a neglect of care and safety for Maddie.

Accused

Hats off to Gonçalo Amaral for the courage to bring the investigation results into the open. The family has never pressed charges against him for his candour and within the Portuguese judiciary he is considered to be a hero. The tens of detectives who worked on the investigation eventually had only one thought: rest in peace dear Maddie.

Assessment of the effectiveness of the Find Madeleine PR campaign launched after the disappearance of Madeleine McCann

In May of 2007 four year old Briton Madeleine McCann disappeared from her parents’ holiday apartment in Portugal. The story has become one of the most extensively covered subjects in media in 2007 and beyond.

The missing child’s parents – Kate and Gerry McCann – have started an extensive PR campaign to publicise the search for little Madeleine. Looking objectively from a time perspective assess the effectiveness of this campaign and draw conclusions about audience’s and media reactions.

The extensive quantitative research, complemented by interviews with experts, have demonstrated the failure of the campaign in PR terms, as McCanns have consequently overshadowed their own daughter in the media spotlight.

Introduction

On Tuesday the 11th of March 2009 Commons’ Culture Select Committee held a meeting over the review of privacy laws in Britain. One of the speakers was Gerry McCann, a cardiologist from Rothley. When addressing the Committee he said: “Our family has been the focus of some of the most sensationalist, untruthful, irresponsible and damaging reporting in the history of the press, the whole thing turned into “Kate and Gerry show” (BBC News, 2009). The case he was referring to is the media coverage of the search for his missing daughter, Madeleine McCann. Max Clifford, an experienced publicist, referred to this coverage as “probably the biggest story I can remember in the 45 years I have involved in the media industry; it had a live of its own” (McCanns versus the Media, 2008)

Madeleine disappeared from a holiday apartment in Praia de Luz in Portugal, Thursday evening on the 3rd of May 2007. The resort itself, located on the Portuguese shore, belongs to Mark Warner company, a firm focused on family-oriented holidays, “leading the way in childcare for 30 years” (Mark Warner Official Website, 2009). Madeleine’s parents, both doctors, were not present in the flat at the time, as they were dining with friends at a tapas restaurant, located around 120 metres away. Madeleine was tucked in as were her two siblings before her parents left for the evening meal. McCanns’ dining companions have also left their offspring in their bedrooms and regular checks on the sleeping children were carried out approximately every half an hour (Collins, 2008). Collins (2008) asserts that the resort offers a crèche free-of-charge and a babysitter for a minimal fee (p. 23), but both McCanns and their companions decided to use their checks system, which they have also applied during a previous holiday in Greece.

The flats where the children slept have been left unlocked for the convenience of parents carrying checks. It was reported that the McCanns’ party of nine has been dining in the restaurant every night since their arrival, always without children and “consuming an average of eight to ten bottles of wine with and after their meals each night” (Collins, 2008, p.XXXIV).

The absence of Madeleine in her bed has been discovered by her mother just before 10PM that night, with Police being notified shortly and the volunteer search starting immediately.

The news of missing British girls, who disappeared on the Portuguese soil have hit the morning news in UK the following morning (Bennett, 2009).

The effort of both Portuguese and British Police failed to locate Madeleine or her body and didn’t identify the disappearance neither as abduction, accident nor murder. The case remains unsolved as of April 2009.

The disappearance of a child, however devastating and terrifying, is sadly a daily occurrence. Collins (2008) gives the number of 846 recorded cases of child abductions in 2002/03, “while the total number of missing children (runaways for any reason) is estimated at 70,000 annually” (p.165). In Italy, police records show that 1,850 minors went missing in 2005. In Belgium, the number of dossiers reported by the Police in 2005 was 1,022 (Collins, 2008). According to recent report by PACT, the problem is not tackled seriously enough, as different locations around the UK have different success rates in locating missing children, with recent report about missing children being entitled “The Postcode Lottery” (Parents & Abducted Children Together, 2009).

With a child going missing nearly everyday, the Madeleine McCann’s story appears to be attracting enormous amounts of media coverage. There are many factors that have attracted media to this particular news.

Issues like race, gender, age and location have been raised by commentators as key elements contributing to the perception of newsworthiness of this story.

Firstly we need to understand why the media attention was attracted in the first place, as it was in fact triggered my the Mark Warner company, the owner of the Praia da Luz resort. The McCanns have been provided with the media assistance immediately in the hours following the disappearance (BBC News Website, 2008). Mark Warner has hired Alex Woolfall, crisis management head at Bell Pottinger, who was there to help McCanns (and of course Mark Warner): “for the first fortnight after Madeleine disappeared, he was on the spot in Praia da Luz, acting as go-between for the family and the growing pack of journalists” (The Times Online, 2007).

Therefore the news of missing child and the search being underway made it to the UK within just few hours. According the company’s website “each year over 75% of company’s holidays are sold on basis of recommendation or repeated booking” (Mark Warner, 2009), so with a child going missing on the premises became a time of trial of the firm.

We have identified “the trigger” behind such a quick media coverage – the Mark Warner’s PR team. Soon McCanns gained powerful allies: celebrities, businesspeople and politicians: speaking publicly of Madeleine or contributing financially to her search.

Soon Find Madeleine McCann Fund has been set-up in purpose of financing the search efforts and from this fund the first McCanns’ spokesperson Justine McGuiness was being paid her salary (Find Madeleine Official Website, 2009). McGuiness resigned in mid August and has been replaced by Clarence Mitchell, a former journalist, who quit his job at Foreign and Commonwealth Office, because “he felt so strongly that the couple were innocent and he wanted to help them” (The Independent on Sunday, 2009).

His connection to Commonwealth Office led media to report, that he was sent by the Government, but he was in fact a private employee paid by the one of the Madeline Fund contributors, Sir Philip Green of Top Shop (The McCanns versus the Media, 2008). Soon after he took over, McCanns have been named official suspects the Portuguese Police investigation (Collins, 2008).

These two media professionals have been the driving force behind the PR campaign. McGuiness was McCanns’ spokesperson in the immediate aftermath after the disappearance and led the efforts to publicise it, to made the story known. Clarence Mitchell took over just days before McCanns being named official suspects and he faced another task: to defend McCanns’ image and make sure the search remains the key angle in the coverage, rather than McCanns’ suspected involvement.

We can see that McCanns have invested in PR services to publicise the search of their daughter, as they have appreciated that the publicity is greatly aiding the search of any missing child. The documentary “The McCanns versus the Media” (Al Jazeera English, 2008) quotes Gerry McCanns’ sister, who explains that “It was the Centre for Missing and Exploited Children who contacted [the McCanns] and told [them] that the only way to find a missing child is to publicise it; the only times the children have been found [it] was after they have been publicised”. But inevitably media coverage generated by their team has been damaging to the country’s tourism industry and triggered a conflict with Portuguese Police, forced to conduct a sensitive investigation under scrutinising media spotlight.

Martin Brunt, correspondent for Sky News identified some of the key factors in the coverage: McCanns had all that was needed for a “perfect storm”: the right place, right time, the right circumstances and appearance and the right company (Mark Warner) backing them up. But somewhere it all went wrong, with McCanns becoming “macabre celebrities” on their own right. The tone of reporting seemed to drastically changed and McCanns have became a subject of coverage that Gerry was referring to in his speech to the MPs.

The campaign is a valuable example that media students can learn from.

The questions that this dissertation is interested in answering are:

[1] Was the Find Madeleine PR campaign effective?
[2] What conclusions can be drown from analysis of the campaign in terms of successful and unsuccessful elements?

Gerry McCann's fitness to practice

It will be recalled that a number of people recently felt concerned about the severe psychological and medical problems that the McCanns said they were suffering from, in a writ claiming a million quid from Goncalo Amaral - whom their lawyer said should be 'punished'.

There was concern that two doctors whose problems were as severe as they described* could be regarded as safe to practise.

Hence many letters were written to the 'Fitness to Practice' Department of the General Medical Council.

Apparently, it's quite O.K. to have all these problems, so long as they're 'safely controlled', for this is what one complainant has received today from the GMC:

McCanns libel lawyer accused of writing a writ full of crap


Isabel Duarte's writ is written in gobbledygook. Gobbledygook is an English term used to describe nonsensical language. In other words, mumbo-jumbo. This is technical language that is difficult to understand and seems to have no sense, for example, a bunch of legal mumbo-jumbo. A pile of crap. The McCanns writ "alleges that Mr Amaral has damaged their reputation ‘causing indescribable devastation and suffering’ and put in danger the well-being of their children, twins Sean and Amelie, four, and particularly Madeleine".

What reputation would that be? Professional doctors who thought it was safe to leave 3 children under 4 years of age unsupervised whilst they went out for drinks and dinner with their friends? I would say that that has potentially put in danger the well-being of their children. It is doubtful that Madeleine can be put in any more danger, in all likelihood she is already dead. Mr Amaral is innocent of any blame in this respect. He did not come onto the scene until after Madeleine was made to disappear in rather mysterious and suspicious circumstances.

"Journalists in East Timor have reacted negatively to a set of five media laws drafted by Portuguese lawyer Isabel Duarte. The United Nations Development Programme hired Duarte to draft the laws on behalf of the government".

re: Fitness to Practise: Dr Gerald McCann and Dr Kate McCann (formerly Dr Kate Healy)

I write to bring to your attention a report about the above couple, both doctors, published in the Sunday People yesterday.

Dr Gerald McCann and Dr Kate McCann are the parents of Madeleine McCann, who was reported missing by her mother at around 10.00pm on Thursday 3 May 2007. The circumstances of her disappearance remain mysterious and as yet unsolved. They were made official suspects of involvement in their daughter’s disappearance in September 2007, a status that lasted until July 2008 when the Portuguese judicial authorities concluded that at that time there was insufficient evidence to charge them or anyone else with a crime against Madeleine.

Yesterday, the Sunday People published an article based on what they said was a 34-page libel writ served in Portugal against Goncalo Amaral. The McCanns and their advisers have already announced in the press that they intended to sue Mr Amaral for libel. Mr Amaral was the senior investigating officer in the case until he was removed from the investigation in controversial circumstances in October 2007. A month earlier, he was the man responsible for declaring the McCanns to be official suspects in their daughter’s disappearance.

The Sunday People says it has translated the libel writ from the Portuguese. The McCanns are claiming damages of £1 million from Mr Amaral. I wish to bring to your attention the medical and psychological condition of these two doctors, one of whom continues to practise, and both of whom we understand to be on the GMC Register.

The writ says of Dr Kate McCann that she is ‘deeply and seriously depressed”. The writ goes on to describe both of the McCanns as suffering from:

■permanent anxiety
■insomnia
■lack of appetite
■irritability
■indefinable fear
In the writ, according to the Sunday People, the McCanns further describe both of themselves as:

■“totally destroyed”
■“irreparably damaged”, and
■“totally destroyed from a moral, social, ethical, emotional and family point of view”
The question that arises is whether either of these doctors is fit to practise or indeed to remain on the GMC Register, at least until these serious psychological problems, suggestive of mental illness, subside. We suggest that the appropriate committee of the GMC should consider (a) suspending them from the GMC until a psychiatrist deems that they have recovered from the above symptoms and (b) providing them with the expert psychiatric help and counselling that anyone exhibiting such severe symptoms should receive from the N.H.S. Presumably if the McCanns are exhibiting these symptoms there are reports available from their G.P. or a psychiatric specialist confirming those symptoms.

The other possibility of course, is that the McCanns are grossly exaggerating the extent of their depression or even lying about it, in order to make as much money as possible from Mr Amaral. If that were the case, there would definitely be a whole series of other questions about their fitness to remain in practice and remain on the GMC Register. Many videos and still images exist of the McCanns laughing and joking and appearing to be anything but severely depressed. That would suggest at least the possibility that they have deliberately exaggerated their sadness at and reaction to the loss of Madeleine in order to make as much money as possible from their proposed libel action.

Finally, I would like to take this opportunity to enclose a complimentary copy of a book written by Tony Bennett, titled: “What Really Happened to Madeleine McCann? - 60 reasons which suggest she was not abducted”. The book suggests that the McCanns’ claim that Madeleine was abducted runs counter to a mass of evidence. Its conclusion is precisely the same as that of Mr Amaral, whose book: ‘A Verdada de Mentira’, (“The Truth About A Lie”), explains that the evidence suggests that Madeleine McCann died in her parents’ apartment and that her body was subsequently hidden or otherwise disposed of. I should add at this point that a great many British people would categorically refuse to be treated by either of the McCanns because of what they have seen of them on TV, or read about them in newspaper articles, or in Mr Bennett’s booklet. For them, the issue is trust. They do not feel that they can trust the McCanns.

It is vital for both the medical profession and for the patient that patients have complete trust that their doctors are trustworthy. A clear example among many of why the McCanns cannot be trusted is that initially they claimed that an abductor had jemmied open the shutters to their apartment to gain entrance. Only when this was exposed as patently untrue did they then change their story, now claiming that the abductor must have entered by an open patio door and escaped with Madeleine out of a small window. These are matters we know have been brought to your attention by many others apart from us. We trust that you will take appropriate action with regard to the McCanns and their fitness to practise, taking account the contents of this letter and all the other evidence about their fitness to practice which is available to you.

Finally, I understand that there may be a form on which official complaints should be submitted. If such a form exists, please could you send me two copies of such a form, one for each doctor.

Exclusive: Maddie parents sue cop for £1M book profits

Kate and Gerry McCann are suing the police chief who bungled the investigation into their daughter's disappearance - and blamed them for her death - for £1million.

In a 36-page writ handed to the Sunday Mirror, they lay bare in painful detail how Gonçalo Amaral's accusations left them "totally destroyed" and caused them "irreparable" damage.

It also gives a harrowing insight into the day-to-day life in the McCann household as they struggle to cope without Madeleine.

The writ - which the Sunday Mirror has had translated from Portuguese - outlines how the couple both suffer from "permanent anxiety, insomnia, lack of appetite, irritability and an indefinable It also says Kate McCann is "in a deep and serious depression".

'Disgraced former police Amaral has pocketed £ 1million writing a lurid book and making documentary full of cruel about Madeliene and her And now they are suing him every penny of it.

He accuses them of accidentally killing their three-year-old daughter and then covering up her death.

Amaral, who was thrown off case after five months, repeatedly claimed Madeleine in the holiday apartment on Algarve. In his book The About The Lie he spouts his theory that the couple hid daughter's body.

The lawsuit also highlights fears for four-year-old twins and Amelie when they start later this year and begin to hear rumours that Madeleine is dead.

And it accuses Amaral of being a self-obsessed, manipulative money-grabber with no morals.

The couple, both 41, have hired Portuguese lawyer Isabel Duarte to sue Amaral for defamation and for breaching their human rights. Mrs Duarte, 54, said: "Somebody has to stop him and shut him up. He is a rich man now, earning millions from the distress of this family. We believe he has made up to 1.2million euros (£1million) from the book and the video. We want the court to punish him by taking at least that much from him."

The McCanns have a good case for defamation as they have already been cleared by Portugal's Attorney General. The case will go to trial in Lisbon next summer and Amaral, 49, could force the McCanns to take the stand. Madeleine is named with Kate and Gerry and the twins as a complainant in the lawsuit, lodged on June 24.

The McCanns, both doctors from Rothley, Leics, claim Amaral's repeated insistence that their daughter is dead has stopped people looking for her. The lawsuit states: "Madeleine has been deprived of the possibility of a fair and adequate investigation into her disappearance, putting her moral and physical integrity at serious risk."

It says Gerry and Kate have been "totally destroyed from a moral, social, ethical, emotional and family point of view, beyond the pain that the absence of their eldest daughter causes them".

The couple want a minimum of £430,000 in damages for Madeleine, which will be used to keep the search for her going. They also want a minimum of £215,000 each for them, and another £86,000 each for the twins. It is thought any money they get will go to the Maddie fund.

Amaral's book has sold around 330,000 copies worldwide. The fatherof-three has become a celeb in Portugal, and has a new Jaguar.

The McCanns say his "sole objectives" in writing the book were "to earn a lot of money", using "lies". It says the book and his 50-minute documentary, which has been shown twice on Portuguese TV, are "manipulative, perverse, false, destructive, defamatory, deeply damaging and therefore illegal".

Amaral was in charge of the 30 detectives looking for Madeleine after she vanished in May 2007 on a family holiday in Praia da Luz.

He was largely responsible for making the McCanns "arguidos" - suspects - four months after Madeleine vanished. But he was kicked off the case in October 2007 days after the Sunday Mirror revealed he was working as little as four hours a day and was enjoying long, boozy lunches.

He was removed from the case on his 48th birthday. Amaral took early retirement shortly afterwards, ending 27 years on the force.

He began writing his book, promoting it by travelling around Europe giving newspaper interviews.

It went on sale in a blaze of publicity in July last year - three days after the McCanns' "arguido" status was removed. Earlier this month Amaral was charged with torturing a witness during a separate missing child case. He faces jail if convicted.

WHAT THEY ARE DEMANDING

£430,000 damages for Madeleine which will be used to continue the search for her.

£215,000 for each parent for the emotional distress the book has caused them. They say they suffer 'permanent anxiety, insomnia, lack of appetite, irritability and an indefinable fear'. The writ also says Kate McCann is 'steeped in a deep and serious depression'.

£86,000 for each of their twins Sean and Amelie, who could hear his allegations when they start school in September.

HOW HE MADE HIS MONEY

£500,000 from the book which has sold 180,000 copies in Portugal alone.

£430,000 from the extra 150,000 books which have been sold in Brazil, France, Germany, Italy, Spain and Holland.

£100,000 for a TV documentary watched by one in five people in Portugal - 75,000 copies have sold on DVD.

McCanns ask for thousands of Euros from Amaral

Donations increased after the Oprah Show but not enough to keep the fund active for much longer.

One hundred to 500 thousand Euros compensation is the amount Kate and Gerry McCann want to receive from Gonçalo Amaral, the former coordinator of the Department of Criminal Investigation (DIC) of the Judicial Police (PJ) of Portimão. The lawsuit, according to the McCanns, aims at putting money into the fund that the couple uses to finance its expenditures of the campaign they have promoted since the disappearance of their daughter.
The information has been confirmed to the 24horas by a source of the “Madeleine’s Fund – Leaving No Stone Unturned”, the financial fund created by Maddie’s parents nine days after the disappearance of the child.
“The couple is hoping to receive at least a six-digit compensation,” said the same source adding that “other legal actions are not excluded, which will help putting money into the Find Madeleine fund and helping the campaign.” 24horas knows that since 2007 – soon after Kate and Gerry McCann’s return to England – the couple’s lawyers have a list of media, of journalists and even of Portuguese and English blogs that the McCanns are looking at as a possible “target”.
Gonçalo Amaral is the main target of the McCanns: according to the same source, the person in charge of the investigation into Maddie’s disappearance is “the only person who continues to question Madeleine’s abduction” and this “affects the credibility of the couple and the work of the investigators”.
The former PJ coordinator’s movements have always been the target of greatest attention for the detectives hired by the McCanns – an initiative started off by the Spanish people from Metodo 3 but remaining up to date in a report disclosing information about Gonçalo Amaral’s private and professional life and lists details such as the family’s bank accounts, and even the list of their closest friends. Part of this report, however, has been transmitted to a Portuguese lawyer who has used it in declarations and accusations related to another process.
The lawsuits seem to be the best means Kate and Gerry McCann found to finance their activities of the “Find Madeleine” campaign – a private organisation mainly managed by the family and now having Kate and Gerry as directors.
After having received more than 700,000 Euros compensation in lawsuits against various English newspapers, which have never gone through any court rooms, the couple is now aiming at various targets in Portugal: “It is clear that Amaral is the main target, but other possibilities exist, especially amongst the media and on the internet where defamatory statements regarding the couple have been made,” said the same source.

They have quizzed a witness who says sex attacker Hewlett told of being outside the apartment where Maddie was snatched "several times". Ex-ScotGuard Peter Verran, 46, was questioned by a detective from Leicestershire for two hours this week about his three months in Morocco with Hewlett, 64.

Peter told the Sunday Mirror: "He seemed interested in how Hewlett told me he packed up and left Portugal within 30 minutes shortly after Madeleine vanished."

“Many people linked to the Maddie case and the investigation made in Portugal, were or are still the target of tapping and surveillance,” said a source of the Home Office to 24Horas in answer to the affirmations made by the ex-coordinator of the Department of Criminal Investigation (DIC) of the Judicial Police (PJ) of Portimão.
Gonçalo Amaral said that he was “under surveillance” and he knows that his “phone is being tapped.” The former head of the investigation into the disappearance of Madeleine McCann “does not know who is watching him”, but he affirms that his email has been the target of a constant curiosity and that part of this information has been transmitted to the McCanns.
“At the moment, there is information which has to be developed regarding the localisation and what might have happened to the body of the young girl,” said Amaral, accusing the Public Prosecutor (PGR) and the management of the PJ of making a taboo of the Maddie case, where “nobody does anything” allowing “that people external to the Portuguese justice and police force investigate crimes under the PJ’s responsibility”.
Gonçalo Amaral, who, until now, has not received any notification regarding the complaint for defamation announced by the McCanns, confirms that he will sue Kate and Gerry McCann and will prove that an “agreement existed” between the couple and the British police during the investigation, which supposedly influenced the end result of the investigation.
Maddie’s parents want to prevent the publication in English of the book “Maddie: The truth of the lie”, in which the ex-coordinator of the PJ reveals many details of the investigation he was leading in Praia da Luz and where he sustains the theory of Madeleine’s death. The decision of the couple was supposedly taken as a consequence of the disclosure of the documentary based on this book that TVI (Portuguese TV channel) broadcasted and is available on internet with English subtitles.

Amaral shows the Public Prosecutor to have “trapped” him in the Leonor Cipriano case.

“I haven’t got any doubt that there was a trap from the Public Prosecutor which then led him to say during the judgement that I made a false testimony, because I should have been made arguido the first day, at the first hour, like my colleagues,” said Gonçalo Amaral on TVI (see video) on the fact of having been condemned in the lawsuit of Leonor Cipriano, confirming that he is going to appeal against the sentence.
The ex-coordinator, talking about his most recent experience made with law in Portugal, gave the example of two complaints presented around the same report worked out by an association in the Joanna Cipriano case: the complaint presented by Amaral over a year ago is on standby, whereas the second, presented by the opposing party, already has some arguidos.

Did you then return 3 weeks later to put Maddie's DNA in the McCanns's hire car?

Why don't you incriminate yourself in this inquiry for the sake of the McCanns?

Portuguese police have dismissed up to four potential Madeleine McCann leads in the past week by telling informers: 'The case is closed, she is dead.'

All the witnesses who came forward offering information about the missing youngster were waved away by indifferent officers in the Algarve.

What's a "disgrace" is these two NHS doctors who staged a fake abduction and concealed Maddie's body and then set about to blame everyone else for their own crimes and raked in millions of pounds from the generous public which helped pay their mortgage! It's also a disgrace that the McCanns have demonstrated time and again that they are the ones with something to hide by refusing to answer police questions, refusing to take part in the official police reconstruction and refusing to request that the investigation remains open.

Since when are suspects in their own daughter's death and concealment allowed to dispense with an official police investigation and hire private detectives and double-glazing magnates to interview 'suspects' and collect their DNA (even though he's a known and convicted paedophile whose DNA is already on a database)?

Kate and Gerry McCann are re-writing the Law for their own agenda and the Leicestershire Police and Government are letting them get away with it - and indeed are fully supporting them as can be seen from the Police website which tells members of the public to pass information directly to the McCanns rather than themselves.

Will this bizarre concept now apply to all criminals or just Kate and Gerry McCann because when FOI requests are put to the Leicester Police about the McCanns the police simply refuse to reply.

Paulo Reis: Another “McCannipulation”?


Gerry and Kate McCann will sue Gonçalo Amaral, for defamation, according to several Portuguese and British newspapers. The story is based on a statement issued by the parents of Madeleine McCann and also in some ignorance of legal matters. What Mr. Edward Smethurst told “The Sun” shows better what the McCann are planning, with a little help of a Portuguese lawyer, Mrs. Isabel Duarte, who is very close to “Expresso”, a leading supporter of the McCann version of events (If you want to know why, check this)


The McCann are not filling a crime complaint against Mr. Gonçalo Amaral – they are suing in a civil court, not in a criminal court. Why? Because they are not looking for a conviction for defamation in a criminal court, they are looking for receiving a large amount of damages, in a civil court – something that, as Mrs. Isabel Duarte knows, is easier to achieve, in the Portuguese legal system, comparing to a conviction for defamation on a criminal court, in a case that is related with Freedom of Expression, Opinion and Press Freedom.


Just another detail: Why now? When was Mr. Gonçalo's book published? Could the reason be the lack of public reaction to the last “investigation” and “new suspects” revealed?
