MCCANNS v BENNETT - The committal to prison trial will take place for 1 or 2 days, sometime in April or later

As a result of a letter from Carter-Ruck dated 13 January and received by me on Friday after I returned from a short holiday, I can now confirm that the ‘Committal Hearing’ where the McCanns are seeking to have me committed to prison, fined, or have my assets seized (and all three are possible in a serious contempt case) will not now take place on 8 February.

The McCanns asked for the date of 8 February to be used for a Directions/Procedure hearing called a ‘Case Management Hearing’, to which I agreed as I need a lot more time to prepare my defence.

Mr James Tipp, Deputy Court Manager and Court Co-ordinator, has agreed and in an e-mail to Carter-Ruck also dated 13 January, he wrote:

“The committal hearing on the 8^th February 2012 will now be listed for a two hour directions hearing as requested [by Carter-Ruck]”.

THE DRAFT ORDER

Carter-Ruck have drafted the Order they would like the Court to grant. It provides as follows:

I must file my reply no later than 4pm on 22 February
The McCanns to have a chance to reply by 21 March
The McCanns’ committal-to-prison application be heard after 10 April
The trial to be fixed for either 1 or 2 days
‘Costs in the case’.

I am likely to seek to change those proposed directions, if only to seek a great deal more time to prepare my defence. The McCanns on their own admission began together with Carter-Ruck to prepare their Committal application back in June. They served it to me, unannounced, six months later, by two men in a limousine on 1 December, in a box containing five thick Lever Arch files and 2,000 pages of argument and evidence.

LEGAL ADVICE AND COSTS

For the record, I have taken the advice of a local Solicitor who advised that the terms of the undertaking I was forced to give in November 2009 were unusually wide and there were good grounds for them at least to be varied.

He did advise that I should be legally represented if at all possible, but after making enquiries via solicitors and the Legal Services Commission who run the Legal Aid scheme, no Legal Aid is possible to anyone who has savings over £8,000, which I have. He then quoted me figures for advising and said that in view of the many complexities and unusual features of this case, he would need to seek a written Opinion from an experienced barrister. Because of the sheer amount of material which the McCanns have placed before the court, and the need for both the solicitor and barrister to read and consider all the documentation, plus look up and apply all relevant law and case precedent, the cost of being advised alone would run to a 5-figure sum.

My solicitor is not one of the very few solicitors who has what are called ‘rights of audience’ in the Royal Courts of Justice, which means that if I wish to be represented in court, this would mean I would again have to hire a barrister. Again, I have been advised that if you include court attendance on say 3 days of both barrister and solicitor and possibly solicitor’s clerk myself, and dealing with all the preparation of the case, correspondence with the court and Carter-Ruck, preparing Witness Statements, Skeleton Arguments of the case and so on and so forth, the whole bill for legal representation alone would cost potentially tens of thousands of pounds, money I just haven’t got.

I therefore have to struggle on, on my own and unaided, on what feels like a very unequal contest indeed.

The main bone of contention for the McCanns is the opinions I have given on this very forum and on the Madeleine Foundation website.

They accept that I have adhered strictly to the undertakings I gave (1) to close our former website, (2) not to sell or distribute the ‘60 Reasons’ booklet and (3) not to sell or distribute the ‘10 Reasons’ leaflet, the only exception to that being the sale of a book to a photojournalist, Mike Gunnill, who under the name of Michael Sangerte insisted that he needed a physical copy of the book ‘for the purposes of historical research’ - after I had initially refused to sell him a book.

THE HEARING ON 8 FEBRUARY - WILL I BE ENTIRELY ON MY OWN?

I have asked via a unit called the Masters Support Unit at the High Court if the hearing on 8 February will be in open court or in chambers, and have also asked if I could bring a relative or a friend to take notes at the hearing. I got a very short note back saying that all the answers are in a book called ‘Civil Court Practice’, otherwise known as the ‘White Book’, which I could buy from a legal bookshop. Even to get that answer took four e-mails dated 23 and 30 December and 5 and 20 January. I am still trying to find out if anyone is allowed to accompany me to the hearing.

CARTER-RUCK's COSTS

I have raised the question of costs with Carter-Ruck, given the following statement by Dr Kate McCann in her book, ‘madeleine’. On page 287 of that book, she wrote: “Adam Tudor and his colleague Isabel Hudson continue to do a vast amount of work for us, without payment, most of it quietly, behind the scenes”.

Not so in my case, it seems. By way of response, Carter-Ruck have clarified the position so far as claiming costs against me is concerned. This is what they have said:

“In relation to your queries about our clients’ costs, we entered into as fee-paying retainer with our clients in relation to this Contempt of Court application. As previously indicated ,our clients intend (as they are entitled) to seek an Order for the repayment of their costs by you in the event that their application is successful”.

I think I have previously indicated that the McCanns claim I have breached the undertaking I gave the High Court in November 2009 in 149 instances, once by selling a book to Mike Gunnill, and on 148 other occasions by words I have used in postings, articles and leaflets published between January 2010 and August 2011.

SURPRISING CLAIMS OF LIBEL

There are not a few surprising claims of alleged libel.

Alleged breach of undertaking number 148 is described as ‘The 48 Questions video recording created by and featuring the Defendant”. When this was brought to our attention by Carter-Ruck in August, we decided to voluntarily remove that video from YouTube, despite the fact that we could not see how a mere recital of those 48 questions could possibly constitute libel when they consist of a list of questions made public by the Portuguese Police, and are still available to read on the BBC website, and have been published in numerous British and Portuguese newspapers and elsewhere on the internet.

Alleged breach of undertaking number 2 is described as “The Madeleine McCann Case Files, Volume 1, booklet published by the Defendant”. Once again, seeing that this is merely a compilation of a selection of documents made public three years ago by the Portuguese Police, it is hard to see where the libel lies in reproducing them. Furthermore, Carter-Ruck do not specify what parts of that book are said to be libellous. For example, is it possible to view Inspector Tavares de Almedia’s interim report containing the police team’s assessment of what may have happened to Madeleine McCann as ‘libellous’?

I should add here that “The Madeleine McCann Case Files, Volume 1”, was first published by us in late January 2010. The McCanns have made no objection to the publication of this booklet during their occasional correspondence with me during 2010 and 2011 and I confess I was hugely surprised to find that they regarded this as libellous. In their recent letter of 13 January 2012, they say:

“You are continuing to publish some of the publications complained of in our clients’ application against you for Contempt of Court - most notably, by continuing to offer the booklet “The Madeleine McCann Case Files Volume 1’ for sale via your website”.

We honestly cannot see on what grounds the reproduction of e.g. the 48 questions, the interim report of Inspector Tavares de Almeida, the evidence of Martin Grime, the Gaspar statements and excerpts from the lengthy ramblings of Jane Tanner can constitute either libel or a breach of my undertaking.

Therefore our 108-page book remains for sale on our website, price £4 including postage; now may be your last chance to get a copy to give to your relatives, friends an acquaintances before it is banned, like 60 Reasons and 10 Reasons.

A BATTLE - PICKED

On page 290 of ‘madeleine’, Dr Kate McCann writes this:

“We have taken action against one or two websites, but it has proved almost impossible to get this stuff removed from some of them, particularly those hosted in the USA. Friends flag up some of the worst offenders for us, but in the end it comes down to picking your battles”.

Well, I have been well and truly ‘picked’.

I don’t mean this in any way unkindly, but for those of you who can type away your opinions on what really happened to Madeleine McCann without fear of inviting a libel action, think yourselves fortunate. It’s a freedom that might be curtailed later, if I lose this battle and if Lord Leveson has anything to do with changing press freedoms and internet law.

Finally, thanks so much to all of you who say kind things about my stand. They may not stop me going to prison, paying a heavy fine, or losing all my savings and my home, but I assure you they are a solace and a comfort at a time of stress, and I appreciate each and every one of them.

Who knew what time those SY officers would be going to Metodo 3's offices?

ANSWER: Scotland Yard and Metodo 3.

So, who arranged the photograph?

Was it Scotland Yard? Does this mean SY are working in cahoots with the McCanns to carry out a £3.6 million whitewash paid for by British cash-strapped taxpayers, and didn't mind being photographed?

OR was it Metodo 3. Did Clarence Mitchell and the McCanns arrange for the photographer to be there?

When they are in Spain or Portugal they have the status of tourists.
The boxes were handed over. Without argument, though perhaps after negotiation.

His life has been ripped apart since he led the police investigation into the Millennium’s greatest mystery, and came into legal confrontation with Kate and Gerry McCann. Gonçalo Amaral has lost his family, his business, his assets and the income from his controversial book that states all the reasons why he believes three-year-old Madeleine McCann died in apartment 5A in Praia da Luz back in May of 2007. Now, four-and-a-half years down the line, he faces another hurdle: a trial for defamation of the McCanns – due to start in Lisbon in February – in which the couple are claiming 1.2 million euros in damages. Does he think he can win? “Of course”, he says. This is the man whose maxim is “justice works in silence”. He still believes the case of the world’s most famous missing person will be solved. And he told Algarve123 what he thinks is needed to get there…

You wouldn’t miss him in a crowd. Gonçalo Amaral, 52, is strikingly tall with a penchant for hats. He was wearing a long black coat, a black fedora and a bright red scarf when we met him on the terrace of Casa Inglesa in Portimão. He looked much more like an intellectual than a former police officer, but these days his life is spent largely writing - an activity he’s come to love as much as the police work that used to fill his days.

Our first question: “How’s life?” elicited the reply “Bad!” so any further niceties went by the board.

What Amaral has always maintained is that the McCanns’ zeal for litigation “will not bring their daughter back”. He claims various legal suits against him, and a number of other Portuguese public figures who have verbalised “anti-McCann-story” sentiments, are totally out of keeping with the Catholic faith so fervently embraced by Madeleine’s mother Kate.

“Is it Catholic to hold sentiments of vengeance? To seek to destroy a family as mine has been destroyed?” he asks.

“This litigation will carry a heavy price – but I have faith that the mystery will be resolved. “Even if I “disappear” in the process - as Kate McCann has written that she wishes I would in her book - I have a daughter and lots of friends who will make sure justice is done”.

It may sound theatrical - but Amaral is not about theatre. He is about truth – hard facts, solid investigative work.

“The case has to be re-opened, and I have faith that it will be,” he said. “It will either be when this current “procurador” leaves, or when the current chief of police leaves. It’s not something I am pushing for - even if I could - it’s just something I feel certain will happen. And when it does, the first, most essential thing to be done will be a reconstruction of that very first night – the night Madeleine disappeared. Because that’s what happened: she literally disappeared! The reconstruction will have to involve all the parties: the McCanns and their friends. You see, there are so many inconsistencies in these people’s statements that a reconstruction will very quickly highlight where they have not told the truth”.

An example of the power of reconstructions came only weeks ago in Spain where a father claimed his two children were abducted from a park. A police reconstruction quickly proved that the father had never taken his children to the park: witnesses who had seen him arrive in his car but hadn’t noticed the children in the back seat, were surprised to discover that in the reconstruction the child-sized dummies in the back were clearly visible. The children’s father is now in jail – although the children are still missing.

Amaral explained that when Madeleine disappeared police didn’t organise a reconstruction in Praia da Luz “because there were so many journalists on the ground” – and once the heat had died down, “the McCanns refused. They said any reconstruction should be made by actors – but the whole reason for reconstructions is to use the people involved, and see where their stories don’t add up!”

Going back to that first night is logical: the initial 48-hours after any disappearance are crucial. They can literally mean the difference between life and death – but in Madeleine’s case, Amaral is convinced of the latter. The theory that has led to his prosecution by the McCanns for defamation is clearly set out in his book “A Verdade de Mentira” (The Truth of the Lie) – banned from sale in 2009, and then “released” by the Appeals Court a year later. We say “released” because the books were actually never returned to publishers Guerra & Paz, and thus they and Amaral have had nothing to sell…

“It’s another part of the whole plot to assassinate my civil position,” Amaral says matter-of-factly. “I’ve been left with no chances; no way of paying my debts; liens on my property. I’ve had to move away from my family in order to protect them. My marriage, well, it’s not so good. Not good at all, really. My life seems to be all about divorce…”

So how does he find the strength to move forwards?

“Well, I put the McCanns in a metaphorical box and I am not really thinking too much about the trial in February. I think I will win, and then they will appeal – but I have to have a path. I want to open another consultancy. I had one when I left the police force, but that was destroyed when the McCanns went after me over “A Verdade de Mentira”.

So that’s one thing - and the other is writing. I have recently brought out a new book: “Vidas sem Defesa” about missing children cases in Portugal, and I have another one almost ready (I am not going to tell you what it is about!). After that, I would like to take police “mysteries” and study them and write stories, not novels; stories based on facts to show what I believe really happened. There’s a real lack of books of this type.”

So he’s not angry over the agonies and frustrations he’s endured from what came from essentially doing his job?

“I have my anger well-guarded. No feelings for revenge. Like I say, they will pay for what they have done to me and my family – but through the courts. Even after everything that has happened, I still have faith in the Portuguese justice system”.

And does he have any clues as to what catapulted the Madeleine case into the stratosphere of media attention? Why did the McCanns receive so much help from the British authorities right from the very beginning? And why were they and the so-called Tapas 7 never taken to task for child neglect – considering that they all left their children alone at night during the ill-fated holiday?

“Ah, now there we’re getting into politics – and quite honestly, those are questions for the British public to ask. I don’t have to have theories about them. My job was to find Madeleine”.

A job handed to him nearly five years ago – and one that he will never forget.

I am so upset to hear him talk like this. I have been holding onto the thought that at least his family remained intact and would be a support to him. It feels as though it is impossible to do anything to help him, and the small contributions I have been privileged to make towards his legal expenses seem like a useless exercise if his life has fallen apart so much. The McCanns have so much evil to answer for in relation to their own family, but the persecution and destruction of this man takes it to a whole new level. I feel absolutely devastated for him.

I too am worried having read this article, about his desperate state regarding his family and possible divorce. This is not good. Like others I have tried to think that he would survive the onslaught regarding the libel trial but it does seem that its weighing him down. He is confident though that justice will be served but at whose cost?

I am glad he is continuing to write but worry that the proceeds will only go in the coffers of the McCanns.

He needs more support - is there anything else we can do ?

Of course, Gonçalo Amaral - the detective who was in charge of searching for the McCann's missing daughter - isn't the only person they are trying to destroy - there is also Tony Bennett, the secretary of The Madeleine Foundation - who is trying to get the investigation re-opened, and Criminal Profiler Pat Brown...and you can see a list of the McCanns legal actions (at least 24 so far) that they are using the Maddie Search Fund to pay for..... here

Kate and Gerry McCann have arrived to give evidence to the Leveson Inquiry into press standards about their experiences of the media after their daughter Madeleine went missing.

The couple are expected to describe their anger at newspaper stories suggesting they may have been involved in the little girl's disappearance from the family's holiday flat in Portugal in May 2007.

The McCanns, from Rothley, Leicestershire, have previously spoken of their frustration that negative reporting like this was distracting from the search for Madeleine.

Eddie, the British sniffer dog, also did some 'negative reporting' when he detected Madeleine's death scent in the McCanns holiday apartment and hire car

As for the diaries...wasn't it Gerry who had an online diary/blog for everyone to see and keep up to date with their thoughts and feelings? Press intrusion...who made the call to Sky news and Daily Telegraph before the police even got there on May 3rd 2007? If they didn't want press intrusion why make the calls, especially at a time when you didn't know what happened to Maddie, she may have just wandered off and be found...they wanted the press intrusion alright

Why were posters already printed out and being handed on photographic quality paper within 2 hours of Maddie disappearing? and on paper unavailable to purchase in PDL. Where did they get this paper between 10pm and midnight as they discovered in their panic Maddie had gone?mmmmmmmmm...and why an old photo of Maddie

Why did they and all their Tapas friends phone everyone in sight pushing the point the shutters had been jemmied (and immediately putting down the Portuguese police) yet when proven it was a lie, all totally retract from this and admit they hadn't been and it was the patio door that was unlocked? yet 4 years later and having admitted the shutters were not jemmied, they are still going on TV interviews to this day to unsuspecting foreign countries telling their public the jemmied shutter lie with Kates reconstruction, knowing full well they have admitted this is not true?

Why do their twins look so much younger in May 2007 than they did in April 2007? Why do Maddie's cousins look incredibly younger in 2008 than they did in April 2007?

Why do they release pictures of their daughter with fully professional makeup sucking ice creams and laying in seductive poses? where are the pictures from the holiday? there are none of mother and daughter, friends, twins and daughter...none

This is from the top of my head.....I could go on and on

If you ever wanted proof that the UK is riddled with corruption controlled by ones with money...then look no further than the McCanns scam and the ones protecting them

This freak show this afternoon I think had 3 purposes. To get the public sympathy and back on side in believing their scam story. To put down at every opportunity the Portuguese and especially their press as they know next February they will be reporting truths from the forthcoming Amaral case, sowing the seeds now in the British heads how bad and biased the Portuguese are. Their continuing praise of Clarence Mitchell was suspect and a worry he may spill a few beans, so keep him on side with the lavishing praises of how wonderful he was.

Oh and Smethurst....You are not forgotten either.

Madeleine McCann: The SUN 'Target a TROLL' NAMES in FULL!

After the conviction of Sean Duffy, an Aspergers Syndrome sufferer whose main hobbies appear to be drinking excessive amounts of alcohol and posting despicable and hurtful comments on the Facebook tribute pages of tragic individuals who had lost their lives, it coerced the SUN newspaper into action, prompting them to create their ‘TARGET a TROLL’ Campaign!

Kate and Gerry McCann, ever the intrepid publicity hunters, quickly latched on to this ‘CAMPAIGN’ and procured for themselves, (via their infamous PR Mogul-at-large, Clarence Mitchell), EXTRA COVERAGE and column inches galore about the most obvious, heartrending topic and pre-occupation which is perpetually close to their hearts; THEMSELVES.

On the back of the Duffy case comes their NEXT targeted troll; a 17 year old kid called Jack Tims who created a puerile website entitled “If I get 1 Million Likes I’ll let Maddie Go”; a childish prank that deserved to remain entirely in anonymity and obscurity, receiving the very little attention it warranted.

Now, thanks to “Britain’s Soaraway Sun” their THREE MILLIONestimated DAILY circulation figures ensure that the pubescent Tims is afforded all the attention that he clearly craves!

ANOTHER ‘TROLL’ target, named in the report is David Bret. According to the Sun:-

“Blogger David Bret, 57, has also targeted the McCanns with posts wrongly accusing them of being involved in Maddie's abduction — even accusing Kate of being involved in her death”.

I have read MUCH of Mr. Brets’ ramblings, and I have never known him to assert EITHER of those accusations. Nor does the Sun offer any evidence in support of it.

However, I would imagine that David, a renowned International Biographer, will be more peeved at being referred to as a mere BLOGGER than being embroiled in this piss-poor publicity stunt for the McCanns!

HOWEVER, all things been equal, and given that the “Soaraway Sun’s” Campaign is designed to TARGET the hurtful and spiteful TROLLS who suggest that the McCanns may be complicit in the disappearance of their daughter; it is only FITTING that we should all enter into the true spirit of the campaign and “REPORT” them!

So here are a few for starters:-

“McCanns are back in frame” ~ Report detailing the apparent involvement of the McCanns in the disappearance of their daughter after leaked FSS reports suggest that DNA recovered matched Madeleine. For extra EFFECT, the report uses big, bold word type forCORPSE and BLOOD, making for a truly salacious story.

The TROLLS involved??

Step forward ANTONELLA LAZZERI and CLODAGH HARTLEY from the....erm.................SUN!

How about:-

“Blood found in McCann Car” ~ another in-depth report that points out

“Sources said analysis of samples taken from the villa produced “significant” new information that could even lead to arrests within days”.

This particular TROLL was merely referred to as the ‘Online Reporter’ for the .....................SUN!

“Catch 22 Quiz Mother Faced” ~ Detailing 22 of the less salubrious questions that Kate didn’t answer, including

“WHAT did you do with her body”.

“Maddie Special Report” ~ A FOUR page SPECIAL spread, on the McCann case, published in 2008, a year after Madeleine’s disappearance, and including SPECIALLY invited and edited comments from the PUBLIC, including:-

“KATE and Gerry McCann plan to write a book about their "year of hell" since Madeleine went missing. This is distasteful, sickening and outrageous. How can two suspects profit from the loss of their child? The sooner this couple are brought to book for child abandonment, the better”

And:

“WHAT about the year of hell that child has had if she was abducted and is still alive? It's always been about money with Kate and Gerry”

And:

“A MISTAKE is using salt instead of sugar. Leaving three babies alone night after night for the whole holiday, even after Madeleine told them she had cried, is wilful neglect and the sooner the McCanns admit their guilt the better for this world”

TROLLS indeed!

Of course, since those devil-may-care days of free speech, the Sun has since learned new information about the investigation which changes their whole perspective on how they report the case.

Madeleine McCann and Kate & Gerry's PRESS Intrusion

The Press are widely reporting that Kate and Gerry McCann are to participate in the LEVESON inquiry, possibly giving TESTIMONY, alongside several key victims of press intrusion, as the first witnesses in the judicial inquiry into the phone-hacking scandal.

Even though there is categorically NO suggestion or allegation that their 'phones were hacked.

In the interests of fairness and accuracy, it is important to question why, exactly, the McCanns are "Key victims of press intrusion", as described by the Guardian.

Clearly this can't be the SAME Kate and Gerry McCann who contacted the Media BEFORE, or at the VERY LATEST at the SAME TIME as they contacted the Police regarding their "Missing" daughter.

Nor can it surely be the same McCanns who gleefully enrolled the services of Justine McGuiness and Sheree Dodd
(“press officer responsible to act as media liaison officer for the McCann family”)

or the infamous Spin-Meister Clarence Mitchell, who has penned a MILLION column inches in publicity for his 'Clients' regularly briefing EVERY newspaper Editor,
(“Mitchell still has the key phone numbers and e-mail addresses of people in power and will continue to use them. He has attended top-level briefings at No 10 every weekday for the past two years. The McCanns.... want to get messages to the very top that they are innocent.”)

And obviously NOT the same McCanns who set up a MULTI Million Pound MEDIA driven/reliant INDUSTRY/FUND/WEBSITE, masquerading as a CHARITY, within DAYS of Madeleine going missing.

And, presumably NOT the self-same McCanns who accepted a £750,000 fee in newspaper serialisation rights for Kate's book, an "honest and truthful account" entitled 'Madeleine'.

Along with the OTHER graciously accepted fees for such "intrusive" appearances on OPRAH and other television programs.

And, categorically NOT, surely, the same Kate McCann who somehow managed to 'intrude' onto EVERY front page of the Press when the parents of Claudia Lawrence, a missing 35 year old British woman, who was last seen in March of 2009, held a special service, a "candle-lit vigil" for THEIR daughter; whose picture, (where it appeared at ALL), was a mere FRACTION of the size of the lady of the moment.

Whether Lord Justice Leveson gets round to pointing out these 'anomolies' to the Golden Couple at the hearing remains to be seen.

How Brian Kennedy and the McCann Team generated media publicity about a search for Madeleine’s remains in the Arade Dam, Portugal

Here we come to, surely, one of the most cynical and indeed sinister chapters in the whole sequence of events which followed the disappearance of Madeleine McCann. Much more detail is available in The Madeleine Foundation’s lengthy article on its website, titled: ‘The Madeleine McCann mystery and the strange role of Madeira lawyer, Marcos Aragão Correia: His links with the McCanns and Método 3…” (22)

In early February 2008, the British media reported on what purported to be a genuine, altruistic attempt by a Portuguese lawyer, Marcos Aragão Correia, to solve the mystery of what really happened to Madeleine McCann. He said he had used his own money to fund a search for Madeleine’s body in the Arade Dam, in southern Portugal, believing there was evidence that she had been killed and her body thrown into the dam.

In this article I will attempt to provide a number of indications that Marcos Aragão Correia may have been cynically paid by the McCann Team, via Método 3, to generate this story, which featured prominently in the British media over a period of weeks between January and March 2008.

Here are the details that I have been able to research:

It was in late January 2008 that Marcos Aragão Correia first came to public notice in Britain. He came forward with the dramatic news that he was sure that Madeleine’s body was lying in a reservoir. He added various details that suggested that he ‘knew’ Madeleine was dead. He said he had ‘been told’, by ‘underworld sources’, that Madeleine had been stolen to order by a gang of ruthless paedophiles, who had then, in turn, raped her, killed her and then dumped her body at the bottom of a reservoir - the Arade Dam in Portugal.

If anyone else had said this, the McCanns might have been deeply offended, even outraged. But as we shall uncover in the next few paragraphs, Marcos Aragão Correia, at the time of the search of the dam, was in the pay of Método 3, who, in turn, of course, were working for the McCanns. The shocking conclusion I have reached is that the McCann Team not only knew in advance that the ‘Arade Dam search’ story was about to break in the British media; they actually planned and planted it themselves. Brian Kennedy was the paymaster of Método 3, he appointed them and directed their work. So he also both knew and took part in planning this story and generating the media publicity about the search.

One aspect of Mr Aragão Correia’s claims that Madeleine McCann had been killed by paedophiles is that they chimed in almost perfect harmony with the repeated claims of both the McCanns and their team of public relations advisers that Madeleine had been abducted by evil men - quite probably paedophile predators. Story after story had appeared in the press during 2007 claiming that Madeleine had been stolen to order by a paedophile gang. The possibility that Madeleine had been abducted by paedophiles had in fact been specifically mentioned by Dr Gerald McCann the very night that Madeleine was reported missing.

We now need to find out just how Marcos Aragão Correia - up until now an obscure lawyer hailing from the Portuguese island of Madeira - burst on the scene and got deeply involved in the Madeleine McCann case. It’s not easy, since like so many things about this case, much remains hidden and secret - deliberately so, as the McCann Team choose not to tell us, just as Dr Kate McCann chose not to answer the 48 questions put to her by the Portuguese Police, and just as the McCanns and their friends refused to take part in a reconstruction in Portugal of the events of 3 May 2007, the night Madeleine was reported missing.

Kate and Gerry McCann's scam detective agency is investigated

The Madeleine Foundation’s recent article: ‘Leading the Hunt for Maddie: Dave Edgar, the Cheshire Detective’ (3), covers in more detail the deception by the McCann Team over a company described as ‘Alpha Investigations Group’, and I refer readers to that article.

It was on 2 May 2009 that the public were first informed of the appointment of retired detectives Dave Edgar and Arthur Cowley to the McCann investigation team. Indications suggest that Edgar was quietly taken on by Brian Kennedy in November 2008, with Cowley added on weeks or perhaps months later. Crucially, both were to appear in a much-hyped documentary, featuring a so-called ‘reconstruction’ of events in Praia da Luz on 3 May 2007, the day Madeleine was reported missing. The documentary was made by Mentorn Films and was transmitted on 7 May 2007 by Channel 4. It was widely ridiculed as a ‘mockumentary’, since the programme contained no analysis but merely recycled the McCann Team’s version of events.

For example, it claimed that the person allegedly seen by Jane Tanner carrying a child at 9.15pm that evening was one and the same as a man seen by Martin Smith, and members of his family, carrying a child in a different part of Praia da Luz 40 minutes later. The idea that an abductor might have been walking around Praia da Luz carrying an abducted child in his arms was risible. The Channel 4 documentary also claimed that in each incident, the child was being carried ‘in exactly the same manner’. This was patently untrue. Jane Tanner claimed that the child she saw being carried was held by the man’s two arms. By contrast, Martin Smith explicitly said that Madeleine was being carried on the man’s shoulder. That was just one of a number of errors in this attempt by Channel 4 to imprint the McCann Team’s version of events on the public mind.

Returning to the subject of the two ex-Cheshire detectives, the publicity around them in May 2009 claimed that they worked for a well-established private investigation agency, allegedly called ‘Alpha Investigations Group’. It was suggested that Edgar, a retired Detective Inspector, and Cowley, a retired Detective Sergeant, ‘headed up’ this group. The McCann Team needed to ‘big up’ their new detectives.

This was all a deliberate deception, in which a close aide of Brian Kennedy played a part. There never was any detective agency called ‘Alpha Investigations Group’. Instead, what happened was that on 10 June 2009, over a month after all the press reports about the mythical ‘Alpha Investigations Group’, Arthur Cowley registered, in his sole name, a company called ‘ALPHAIG’, Company No. 06929397. Its registered office was: ‘Treetops’, Pant-y-Gof, HALKYN, Flintshire, CH8 8DH.

There was no mention of Dave Edgar being involved with the company. The company has no internet presence, doesn’t advertise in any way, employs no-one, and its accounts, submitted in 2010 to Companies House, show minimal assets and no evidence of trading. To put it bluntly, it is a sham company, and it seems beyond doubt that it was explicitly created to deceive the media and, in turn, the public. Added weight to this suggestion is provided by the revelation that on 12 January 2009, the domain name ‘alphaig.co.uk’ was registered by Andrew Dickman, who is inextricably associated with Brian Kennedy’s own company, the Latium Group. Dickman’s very close business relationship with Brian Kennedy was covered in an article in the Manchester Evening News on 21 May 2007, which informed its readers about a boost for the Kennedy-owned property business, Patrick Properties, named after his son Patrick. The company, said the article, was ‘established in 2002 by Mr Kennedy and managing director Andrew Dickman…’
Why did a right-hand man of Kennedy (Andrew Dickman) register the domain name ‘ALPHAIG’? Why did this happen over a month after the McCann Team was falsely claiming there was an ‘Alpha Investigations group’? Why did Arthur Cowley register a sham company, ‘ALPHAIG’? I suggest that these were deliberate actions, designed to deceive the public into thinking that their willing and kind donations to the Find Madeleine Fund were being spent wisely on an effective and successful private detective agency. This claim was, however, false.

Madeleine Foundation submits evidence to the Scotland Yard Review Team

Further to our preliminary exchange of correspondence with Scotland Yard Review Team about its terms of reference, remit etc., (Note 1 below) in which we were told verbally and in writing that the Review Team was starting with a blank sheet and would consider ANY evidence no matter where it led, we have today by Recorded Delivery letter sent a 32-page letter and a bundle of supporting evidence to the Review Team.

We do not propose to disclose its contents. The Review Team will no doubt assess it, and in any event publication of the letter would risk yet a further letter from Carter-Ruck.

I will just say a few things.

I have spoken to one of the team's Detective Inspectors. He has, in terms, told me the following:

* The exercise is primarily a kind of 'cold case review', looking at all the paper evidence

* He described the volume of paperwork involved in the whole exercise as 'massive' and it was made clear to me that it would take months more work to get on top of it all and make sense of it

* Following the announcement of the review, he said that the Review Team had received many more letters from 'all sorts of people' offering evidence and containing suggestions which 'has added to our workload'

* It was unlikely that many people would be directly interviewed by the Review Team

* This remained a Portuguese Police investigation and was not in any shape or form a 're-investigation' exercise at this stage

* He has given me two contact telephone numbers for the Review Team which I won't disclose. Messages for the Review Team may be left by dialling 101 and asking to speak to a 'Member of the Madeleine McCann Review Team' at Belgravia Police Station'.

I have disclosed to the D.I. and in our letter to D.C.I. Andy Redwood that we have received written evidence of interest from an insider within one of the Madeleine McCann private investigation teams - and invited D.C.I. Redwood or one of his detectives to contact us if he wants to follow this up.

I will just disclose one paragraph from our letter to D.C.I. Redwood:

I know that we can expect the Metropolitan Police to approach the evidence in this case robustly, fearlessly and without favour, and no doubt if this is what happens, along with you and your team following recommended police policy guidelines and procedures, the eventual report will be career-enhancing for all those involved in this review. It only remains for us at this stage to wish you every possible success in uncovering just how Madeleine McCann disappeared and who was responsible.

It will not be a surprise to anyone that our letter and accompanying file of evidence to the Review Team deals contains in considerable detail an analysis of various contradictions, changes of statements and 'backfitting' as between and amongst the McCanns and their 'Tapas 9' friends, which we say is relevant circumstantial evidence.

The latest letter from Carter-Ruck to us insists that there is 'no credible evidence' that the McCanns have lied, or that Madeleine died in their apartment, or that they have covered up anything. It is because of their insistence that there is no such credible evidence that I now face contempt of court proceedings.

It is however worth bringing to mind the report of Britain's top criminal profiler in the National Policing Improvement Agency, Lee Rainbow, who in July 2007 wrote the following:

“Madeleine's father was the last one to see her alive. The family is a lead that should be followed. Contradictions in Gerald McCann's statements might lead us to suspect a homicide”.

Lee Rainbow's report also features in our letter to D.C.I. Redwood.

I would once again urge anyone with relevant evidence to write to D.C.I. Redwood.

This is to inform you all that at 3.35pm this afternoon I collected a large package from my nearest local Royal Mail Sorting Office which they had said on a delivery card was 'a white bag' and they had been unable to deliver whilst I was away on holiday and because it was 'too large for my letter box.

I was able to collect it this afternoon, not knowing what it was.

The lady at the sorting office (she's a Cockney) said as she lugged the package slowly towards me: "Blimey, it's a good job that didn't fall off on to me 'ed".

On reaching home later on I weighed it on my bathroo mscales and it was nearly a stone in weight.

On opening the package, there was a 5-page letter from Carrer-Ruck alleging basically that articles on the MF website, MR leaflets, and around four dozen items on this forum constituted a breach of ONE of the High Court undertakings given by me to the McCanns on 25 November 2009.

The specific undertaking they say I breached was "not to repeat allegations that the Claimants are guilty of, or are to be suspected of, causing the death of their daughter; and/or disposing of her body; and/or lying about what happeend and/or seeking to cover up what they had done".

I have been asked to remove a total of 22 articles from the MF website, and amend or cut two others.

So far as this forum is concerned, I have been asked to remove 42 of my postings, I give a full list of what the McCanns want removed below. I am urgently discussing with admin the removal of those posts from public view and so at any time these may disappear.

Incidentally the removal of all the posts and articles that the McCanns want removed will not necessarily stop the McCanns from bringing contempt of court proceedings, which would be brought before a High Court Judge. If found guilty of contempt, the three main remedies are: fine, seizure of assets, and imprisonment.

It may be noted that I have to date made 3,501 posts on here, and only 42 are deemed by the McCanns to be in contempt, that's less than 1.2%. The other 3,459 are presumably not regarded as being in contempt.

I have endeavoured since 25 November 2009 to stick closley to the facts and what may be deduced from, rather than finger-pointing and accusing - based on the legal advice I received at the time.

The McCanns may have been playing four-ball with us down by the sea-side in Portugal, but they'll need more than a sand wedge to dig themselves out of this.

Remember that trip to the beach on Tuesday 1 May - the one that didn't last too long because the weather was unkind and Madeleine preferred to be with her Mini Club playmates? And how the McCanns took the children back to their separate crèches for the last hour and a half, yet somehow managed to sign them in over an hour beforehand? Well it turns out they did something even more remarkable. They seem to have left Madeleine all on her own at the creche. (Some holiday!).

Although Madeleine was not signed out at the end of the day, her brother and sister were - at 5.20 p.m. We are at liberty to infer therefore that, collectively, their last hour and a half began at around 3.45 p.m., despite all three children having been signed in, apparently, at 2.30 p.m. that afternoon. Clerical error on the part of both parents no doubt.

Now here's the weird bit.

Mark Warner Nanny, Catriona Baker, gave a statement to the PJ on 10 May 2007, during which she told them that the only days they took the children to the beach were Tuesday afternoon (1 May 2007) between 15:30 and 16:30, on Wednesday (the next day) at the same time and on Thursday between 10 and 11 o'clock. (04-Processos, volume IV . Pgs. 870 to 873). She says nothing about any of the trips having been delayed or cancelled.

Which means the McCanns, having decided to take their children to the beach that afternoon for a change, delivered Madeleine back to an empty creche for the last hour and a half (commencing 3.45 p.m. approx.). Cat Baker will have left at least fifteen minutes earlier - for the beach. And the beach being no more than fifteen minutes walk away, the 'lobsters' should already have arrived on the sand before the McCanns had even set off for the creche. Did the two groups pass each other en route? Did the McCanns simply hand over the children there and then? 'Hi Cat! You can take over now. We'll just nip back and sign the registers an hour ago!'

Oh well. An account of the truth that contains only one lie can't be all bad can it? Unfortunately even one lie is one lie too many. And this one concerns a period of time over 48 hours before Madeleine is said to have been 'taken.' It's like having your car stolen on Wednesday and lying to police about where you drove to at the weekend.

There can be little doubt now that the McCanns have as many teeth in their respective mouths as Clarence Mitchell has in his.

Today I phoned the Metropolitan Police to ask about their taking over from Leicestershire Constabulary and had this interesting telephone conversation.I recently learned from a trusted police source that the Metropolitan Police had officially taken up the Madeleine McCann investigation in London. This new line of enquiry is called Operation Grange.

SM: Hello, I’d like to speak to someone in connection with Operation Grange please.
Police: I’m not aware of that Operation…just give me one second.

A minute later the operator returned and gave me another phone number to call.

SM: Hello, I’m just calling to ask a few questions about Operation Grange.
Police: What’s the name of that operation again?
SM: Operation Grange.
Police: Ok, what was that?
SM: It’s the Madeleine McCann disappearance.
Police: Oh, alright ok, fine, yeah, we don’t usually use operation names here, what do you need to know?
SM: There doesn’t seem to be anything in the public domain so when did the operation start and what’s the scope of the operation? I just wondered if you can give me some background on Operation Grange.
Police: We haven’t very much talked to the media about the case at all. What we’ve said is we’re providing expertise to the investigators of the case. The Portuguese Authorities, the Portuguese Police retain lead. We’ve not made any suggestion that they’re not capable of investigating but we are assisting them and we have not given any details on it. It’s unusual for us to do that as it’s abroad and another police force is taking the lead on it.
SM: Is there any reason why the Met took over from Leicestershire Constabulary?
Police: I’m not sure we said anything about it at the time – for various reasons. We can’t be seen to criticize any other force. On the 12th of May the Home Office requested that the Metropolitan Police service bring their expertise to the case and on that evening we said that we would.
SM: And is this a full time operation and what size team is working on it?
Police: As I said we wouldn’t provide a running commentary but at the very beginning we said there were 30 officers who would be deployed, er, not continually but various tasks along with workload they have on other cases, er, but we have deployed 30 officers.
SM: In a normal case in Britain it’s not unusual for the police to give an ongoing commentary as to how it’s progressing so what…
Police: …I’ve only worked here 11 years but I would say it’s not common. We give information whilst it’s appropriate to produce but whilst there’s an investigation going on and where it’s potentially murder, we say very little, we say very little. You read a lot in the press but that doesn’t come from us. We deal with about 250 murders a year and all of them are dealt with in exactly the same way in terms of how we deal with the media.

I also discussed the fact that all FOI requests made to Leicestershire Constabulary under Operation Task were coming back with a blanket “no comment” and a wall of silence. The police officer I spoke to at the Met told me to put in FOI requests to them and do not assume that they would treat them the same [as Leicestershire Constabulary].

I have to say that it was reasonably reassuring to hear that the Metropolitan Police are treating the case as “potential murder” instead of the McCanns’ nonsensical talk of abduction.

It is probably premature to expect miracles but for the first time in a British Police force we can just about hear the cops singing in tune with Goncalo Amaral.

Here's an interesting question posed by one of our forum members regarding letters to and from New Scotland Yard regarding the case review of Madeleine McCann (letters here):

"I'm very confused about this whole process. I don't even understand the scope of this and the possible consequences. Say for instance that they question the parents and Tapas friends regarding the timeline inconsistencies and one of them cracks and reveals they have previously told lies. What can happen after that? Can anyone be charged with anything? Is there a crime like obstruction of justice in Portugal? Would they have to re-open the Portuguese enquiry for any action to follow?"

Tony Bennett's response:

"Good questions.

First of all, this is a REVIEW, similar to what is called a 'cold case review'. Essentially this means a group of officers trawling through thousands of documents and looking for possible new leads and lines of enquiry.

If there is evidence of a crime having been committed by one or more individuals, then the status of the review would change from REVIEW to INVESTIGATION - and, yes, that could lead to ARRESTS.

It is my understanding that as Madeleine McCann is British and all the Tapas group are British and as some of the alleged offences occurred in Britain that IF they have collectively covered up the death of Madeleine in Praia da Luz they could be charged under British law with a whole raft of offences:

* causing or allowing the death of a child (McCanns)

* hiding a body and preventing an inquest (McCanns)

* interfering with or perverting the course of justice - or conspiracy to interfere with or pervert the course of justice (McCanns, Tapas friends, and anyone else involved in the cover-up)

* conspiracy to obtain a pecuniary advantage by deception (all those involved in setting up and running the Fund)

* interference with witnesses (Brian Kennedy).

I think Cameron, Sir Paul Stephenson, and the McCann Team hoped that the Review would merely be an excuse to lambast the Portuguese Police once again for their incompetence, and announce that the Portuguese Police had lamentably failed to follow up potential 'sightings' of Madeleine, therefore giving the McCanns' narrative the official backing of Scotland Yard.

Those of us who believe the evidence strongly suggests that Madeleine McCann died in Apartment G5A have, I believe, a solemn duty to explain this to DCI Andy Redwood and his colleagues."

A message to Pat Brown from a member of our forum:

Pat, if you read this post, please please please push this as far as you can. With a sound professional background and reputation you can do what the rest of us would like to do (red flag all the weirdness of the case to a mass audience and try and get some answers/explanations for the contradictions etc) but do not have the opportunity or access to the right people. This is a Golden Opportunity to change the course of this peculiar situation, where two people seem able to control everyone and everything they wish despite some gargantuan flaws in the theory they are persuing.

The McCanns seem to have a free license to defame anyone who questions their theory, despite there being not a scrap of evidence for that theory. Yet are able to wield the axe over anyone who, using the official investigation files in the public domain, comes up with a different theory or scenario. They can contradict themselves with impunity (see thread on The Eye/Coloboma for a sledgehammer of a lie), but supress anyone who publicises their own spoken error!

I think the McC's should be put in a situation where they clarify all the errors and contradictions they have made as a quid pro quo for the millions and millions of pounds from the Portugese and British public purses they have had spent on this (but they say nothing has been done - pah!)

There has to come a point where the McC's admit the wrongs they have and continue to do, or just go away. This cannot go on for 4 more years, it really can't.

So please Pat, help bring this dreadful media whitewash, this never-ending series of contradictions and arrogant behaviour to it's conclusion for everyones sake. Thank you and good luck!!

Introduction

The McCanns’ chief reputation manager, Clarence Mitchell, recently described the disappearance of Madeleine as ‘a complete mystery’. One of the persons most closely associated with attempts to unravel this mystery is Cheshire-based multi-millionaire and double glazing magnate, Mr Brian Kennedy. The purpose of this article is to examine his actions in the Madeleine McCann case.

There are essentially two rival versions of what happened to Madeleine.

The McCanns claim that Madeleine was snatched from their holiday apartment during the evening of Thursday 3 May 2007. They say this event happened between 9.10pm, when Dr Gerald McCann is said to have left the apartment after checking that all was well with the children, and 9.15pm when their friend Jane Tanner is said to have seen a man carrying a child.

By contrast, the team of Portuguese detectives that originally investigated the case reached the conclusion that Madeleine had died in the McCanns’ holiday apartment and that her parents, with or without the help of others, must have hidden or disposed of her body. The senior detective in the case, Goncalo Amaral, wrote a book, A Verdade de Mentira - ‘The Truth About a Lie’, setting out the evidence for their conclusion.

Many people believe one explanation or the other. Many others do not know what to believe. Leaving these theories aside, we will look at Brian Kennedy’s actions in this case and discuss the extent to which they support one or other of the above accounts of the reason her disappearance.

Brian Kennedy’s connection with the disappearance of Madeleine McCann was first announced in September 2007, four months after the McCanns reported Madeleine missing. He has been portrayed as an unselfish, warm-hearted and generous man who for purely altruistic motives has given up a significant amount of his time and energy and a lot of money to try to find Madeleine McCann. I shall explore that claim in this article.

But first, it is necessary to take a brief look at the life and career of Brian Kennedy prior to September 2007 when his interest in the disappearance of Madeleine McCann became known.

Given that I am currently enjoying something of a reputation as having a big, fat, scurrilous mouth, (possibly true), and that I never know when to keep it closed, (ALSO possibly true); I though I would confound my detractors and keep it short and sweet!

Am I alone in thinking how utterly preposterous and somewhat disturbing it is, that at LEAST 25 Media outlets, Newspapers and BROADCASTERS, are currently reporting about a little girl having been found in INDIA that resembles Madeleine McCann and that the McCanns are awaiting the results of the DNA test; whilst at the same time, the police and authorities in the LEH province of India, the scene of this furore, are all utterly bemused and baffled, asking questions as to what everyone is going on about as they have no KNOWLEDGE of ANY girl having been found OR of any DNA tests!!!

Clarence Mitchell has made about 4 statements concerning this latest "sighting", ALL of which are nonsensical and actually CONTRADICT each other.

Of course, there are MANY people who DO follow this case with open hearts, hoping upon all hope that it IS the little girl, and they will continue to pray and hope for Madeleine's safe return.

They will also lambast and vilify the PRESS and Media who report such "sightings" and developments for raising false hope.

Whereas, if they examined such 'reports' and continued widespread coverage with a little more scrutiny and impartiality, they would arrive at the same, logical conclusion.

That the people with whom they hold in so much reverence, adulation and close affection, (Team McCann), are the ones actually responsible for the stream of fabricated stories, hoax's and fake sightings; that the British PRESS and their respective editors are their servile minions;

And that Clarence Mitchell is their Master!

FOR once, grieving Kate McCann can find something to smile about. So often pictured as a sad, withdrawn figure, she and husband Gerry burst into laughter as they promoted her book about their lost daughter Madeleine.

The couple were in Amsterdam to launch the Dutch edition of the book which they hope will help to boost the search for Madeleine across Europe.

The heart-rending memoir has already topped the best-seller list in Britain and Australia, and hundreds of thousands of copies have flown off the shelves.

A spokesman for publishers Transworld said: “We hope it will reach number one across Europe and that somebody with important information will read it and be moved to come forward.”

Copies have been snapped up in Portugal, where Madeleine, then three, went missing from a seaside resort on the Algarve during a family holiday in 2007. The McCanns, both 43, from Rothley, Leics, have been given a boost by the amount which the book has raised towards their fund to back the continuing search for their daughter.

They say they have new hope that she will be found after Scotland Yard agreed to review the investigation into her disappearance.

KATE McCANN’S book about the disappearance of her daughter has already raised £2million for the Madeleine fund.

In three weeks, 165,000 copies of Madeleine have been sold in Britain, while the translated version is flying off the shelves in Portugal, where it hit number four in the top 10 last week.

Claudia Nogueria, who speaks for the McCanns in Portugal, said: “We hope it will reach the number one position and that somebody living here with important information will come forward.”

The book has also shot to the top of the charts in Australia and will soon be launched in Holland and Spain.

The BBC's Editorial Complaints Unit has published its ruling on complaints that one of their reporters had misquoted Gonçalo Amaral outside the court in Lisbon.

Complaint

The programme included a brief exchange between a reporter and Gonçalo Amaral (a former policeman who had worked on the disappearance of Madeleine McCann and had since written a book on the case). One word in the exchange was bleeped, and the report gave the impression that this was because Sr Amaral had used offensive language about the MrCanns. A viewer complained that this was inaccurate and unfair to Sr Amaral.

Outcome
The reporter's belief, reinforced by others on the programme team who viewed the recording, was that Sr Amaral had indeed used an English phrase which included an offensive term applied to the McCanns. On further examination, however, it became clear that Sr Amaral had been speaking Portuguese, and that an inoffensive phrase had been misconstrued. Upheld

Further action
The Editor of the programme has discussed the outcome with the producer and reporter involved. In future, the team plans to use interpreters if clips from interviews are unclear.

Brian Kennedy via Carter Ruck has raised objections to four articles posted on McCann Exposure. Below is McCann Exposure’s response to Carter Ruck’s ““cease and desist” demand.

To whom it may concern,

Re: Carter Ruck‘s “cease and desist” computer-mediated-communication to WordPress.com dated 2nd June 2011, concerning four articles published at McCann Exposure.
Carter Ruck is in no position to ascertain the notion that Kate and Gerald McCann are “responsible for Madeleine’s disappearance or death” is a false allegation. It remains a mystery as to what really happened to Madeleine McCann. Furthermore, the truthfulness of such a hypothesis is a matter that can only be determined in Court. As such McCann Exposure will continue to hypothesize and debate the possibility that the McCann’s were complicit in their daughter‘s disappearance. Abundant discussion of this nature should be of no surprise given that a number of persons whom have been directly involved in the investigation of Madeleine disappearance have perceived this to possibly be the case.
For example, Mark Harrison, National Search Adviser, presented a report detailing the conclusions of his analysis to the investigation coordinators admitting the possibility that Madeleine could be dead, and her body hidden in an area near Praia da Luz. Based on his conclusions he suggested that in order to follow this line of inquiry specialized dogs should be used. Specifically, an enhanced victim recovery dog trained to detect cadaver scent, and a crime scene investigation dog able to detect human blood. Mr. Harrison also suggested that investigators should concentrate in the apartment where the McCann family had stayed, and in the Ocean Club apartments that had been occupied by their group of friends. He further suggested that “new and deeper searches” to Robert Murat’s home and “forensic searches” to Mr. Murat and his friends’ cars and to the McCann’s hire car should be undertaken. Lee Rainbow, a National Policing Improvement Agency (NPIA) expert, wrote in a report to the investigating coordinators, “It was Madeleine’s father who was the last one to see her alive. The family is a lead that should be followed. The contradictions in Gerald McCann’s statements might lead us to suspect a homicide.” Like Mr. Harrison, he too recommended that the police take new forensics from the McCann’s holiday apartment. Subsequent searches undertaken by Martin Grimes and his dogs on the back of these recommendations lend weight to the hypothesis that a cadaver had at some point been present in apartment 5a, as did the Forensic Science Services initial reports.
In light of this, McCann Exposure proposes that Carter Ruck’s attempt to impress on WordPress.com that the Portuguese authorities “confirmed that there was no evidence what so ever to implicate” Kate and Gerald McCann in their daughter’s disappearance is highly questionable. Additionally, Carter Ruck’s sympathy with “a tragic situation in which Mr and Mrs McCann found themselves” and Brian Kennedy’s significant donations and resources he utilized are of little consequence when alleging that untrue statements, defamation or libel are present on McCann Exposure.
None of the posts to which Mr. Kennedy objects are in anyway “highly defamatory”. McCann Exposure does NOT engage in the publication or encouragement of threatening or harassing content. Thus, this renders Carter Ruck’s statement of “hate content” negligible. Details of Mr. Kennedy’s home address, including an architectural map of Swettenham Hall, is freely accessible via the internet. Photographs of his home and businesses can also be freely accessed via internet searches. In the UK personal information such as home and business addresses are declared when registering a company; this information is also easily accessible via internet searches. McCann Exposure argues that Mr. Kennedy’s privacy and his family’s privacy were compromised the moment he became highly publicized as the McCann’s benefactor. Further, that his personal safety is more likely to have been jeopardized by his dubious business dealings as opposed to a few articles published on an obscure blog that speculates about his interest and involvement in the McCann case. Dear Prime Minister

re: The need for a full public enquiry into the disappearance of Madeleine McCann

Last October your staff kindly received on your behalf our letter and petition in which we set out in detail the case for holding a full, independent, public, judicial enquiry into all aspects of the reported disappearance of Madeleine McCann on 3 May 2007. A copy of that letter is attached for your information.

We write once again to express our dismay at your decision, at the express request of Dr Gerald and Dr Kate McCann, to allocate up to £3½ million, at a time of public expenditure restraint and cuts, on a review of evidence in the case by Scotland Yard, which we understand, may lead to a joint review of the evidence by a joint British-Portuguese team of detectives. Your decision has already been criticised by many media commentators on a number of grounds, including (a) the strong likelihood that it will take years and get nowhere (b) the involvement of Rupert Murdoch and his newspapers in persuading you to take this decision, and (c) the far-reaching implications your decision has for the principle of the operational independence of British policing.

On the latter point, we would anticipate your response being to state that the decision to undertake this review is the decision of the Metropolitan Police Commissioner, Sir Paul Stephenson. However, it is very clear that the decision is in effect a joint one between yourself, your Home Secretary Theresa May and Sir Paul Stephenson who, it appears, was induced by your promising his force £3½ million in extra funding, which is money which obviously has to be taken from budgets allocated for other purposes.

As before, our fundamental reason for asking you to set up a full public and judicial enquiry is that in our view, and in the view of many others, this would be a far better method of arriving at the truth than the proposed expensive and lengthy review process which you have just authorised, at the request of the McCanns. Everyone wants the truth about this case, which the McCanns’ own spokesman Clarence Mitchell admitted in March last year was ‘a complete mystery’. The question is how best to get at the truth.

The two rival explanations of what really happened to Madeleine McCann

There have always been two basic accounts of what may have happened to Madeleine.

The McCanns claim that in between Dr Gerald McCann, who was dining at the Ocean Club Tapas restaurant 120 yards (1½ minutes’ walk) away, completing a long check on his children at between 9.05pm and 9.10pm on Thursday 3 May 2007 - and their close friend Ms Jane Tanner, partner of Dr Russell O’Brien, claiming to have seen ‘a man carrying a child wearing pyjamas’ at 9.15pm - an unknown abductor took Madeleine from her bed, without leaving any forensic trace whatsoever, and without being seen or heard by anyone except Jane Tanner.

The McCanns further claim that the Portuguese investigation into Madeleine’s disappearance was ‘a shambles’ and that the Portuguese police did not properly look for Madeleine and follow up all possible leads. The McCanns say they seek a review because, as they say, such a review just might ‘reveal that one vital clue’, or ‘provide the key that will unlock this mystery’ or ‘give us a vital missing piece of the jigsaw’, these being some of the phrases used by the McCanns to justify the expense of this review and their ongoing private investigation.

By contrast, a great many people consider that there is more than adequate evidence that Madeleine McCann died in the McCanns’ holiday apartment and that her parents and others have covered up this fact, and arranged to hold a hoax ‘abduction’ of Madeleine on the evening of 3 May 2007, Madeleine having already died before that evening’s events. That, as you will know, is the settled view of the former senior investigator in the case, Dr Goncalo Amaral, and most of his investigation team, along with other senior figures in Portugal. Dr Amaral does not say how Madeleine died, as he does not know, but in the absence of any other specific indications, he advances the view that she may have died as the result of an accident whilst her parents and friends were dining 1½ minutes’ walk away. Another view of what might have caused Madeleine’s death is the possibility that she was over-sedated by the McCanns.

We do not wish to review in this letter all the evidence that suggests that Madeleine did die in the McCanns’ apartment, but clearly the alerts of two of the world’s top sniffer dogs, trained by an internationally recognised British police dog handler, to no fewer than ten sites in the McCanns’ apartment, on their clothes, and in their hired car are significant, and remain so, even in the absence of the kind of corroborative forensic evidence that would lead to the dogs’ alerts being admissible evidence in a court of law. There is also a very large amount of circumstantial evidence suggesting that the McCanns and their friends have not told the truth, consisting of a number of changes of story and significant contradictions between their statements that go well beyond the kind of minor inconsistencies that often occur when witness are supplying statements based on their recollections.

The 48 members of The Madeleine Foundation, our many supporters, and a huge number of others subscribe to the view that the balance of evidence points in the direction of Madeleine having died in the McCanns’ holiday apartment. If that hypothesis is correct, then the McCanns’ motive for wanting a ‘Review’ which would now open up the many files that the Portuguese Police have up to now withheld would be clear: not to find Madeleine, but rather to trawl the files for any other evidence there may be against them, so that they can defend themselves and deal with any such evidence.

You may recall that the Daily Mirror published an article in February 2010 which referred to advice given by Lee Rainbow, described as Britain’s ‘top criminal profiler’, to the Portuguese Police in the McCann case. Part of the Mirror’s report ran:

The National Policing Improvement Agency (NPIA) expert wrote a report to Algarve police chiefs giving advice. Details of the confidential report emerged during the final day of a libel trial involving former Portuguese detective Goncalo Amaral, who led the Maddie investigation. Amaral is trying to overturn a worldwide injunction banning the publication of his book Maddie: The Truth of the Lie. In it he claims Kate and Gerry were involved in Maddie’s death and staged her disappearance. His lawyer, Antonio Cabrita, told the court Rainbow wrote: “It was Madeleine’s father who was the last one to see her alive. The family is a lead that should be followed. The contradictions in Gerald McCann’s statements might lead us to suspect a homicide.”

UNQUOTE

One commentator has written in the past few days: “For the Scotland Yard Review to now talk to Lee Rainbow would seem to be a logical and very good place for any British detective to now begin. Call in the very top man for a chat and seek his opinion on the way the investigation should proceed. Why? Because that is why Mr Rainbow was paid (by the very Home Office which has complied with the Prime Minister’s bidding and requested (or ordered) the inquiry). Lee Rainbow is recognised as the most skilful and adept adviser the U.K. has in its armoury. There’s more: the use of ‘Behavioral Investigative Advisers’ in serious cases is recommended at all senior detective training courses. Guess who is considered at the very top of the list of advisers? One Lee Rainbow; he wrote the paper. No PR campaign can ever diminish or cloud that fact. His opinion and views have to be faced and dealt with. It could start the ball rolling and, as in all good detective stories, you should begin right at the beginning and don’t stop until the Sherlock announces who-done-it”.

The advantages of a full, public and judicial enquiry

The main question now is whether the ‘Scotland Yard Review’, or a full public and judicial enquiry, would be the better means of establishing the truth about what really happened to Madeleine, and which of the above hypotheses is correct. Even the McCanns, through their spokesman Clarence Mitchell, accept that their claim that Madeleine was abducted is ‘only an assumption, a working hypothesis’. He said this three times in an interview with Radio Humberside on 6 January this year.

A public and judicial enquiry would have these hugely significant advantages.

It could summon witnesses. The witnesses in such a case need to be heard as soon as possible, all other things being equal. Four years have already elapsed. Already a key witness, Mrs Pamela Fenn, has died. She was the woman who lived above the McCanns’ apartment who heard a child (presumed to be Madeleine) crying and sobbing, ‘Daddy, Daddy’, for 75 minutes between 10.30pm and 11.45pm on Tuesday, 1 May. Already over seven further months have elapsed since we delivered our petition to 10 Downing Street calling for you to set up a public enquiry into all aspects of the disappearance of Madeleine McCann. There should be no further delay in setting up such an enquiry.

The appearance of witnesses at a public enquiry enables both a judge and the public to make judgments on the actions of those involved in any matter. Given the level of controversy about so many aspects of Madeleine’s disappearance, it is vital that we all have a chance to hear what these witnesses have to say. The witnesses can give their evidence on oath, and be questioned. A public enquiry is essentially a search for the truth; in this respect a public enquiry in this case would resemble the actions of a Coroner’s Court at an inquest, ascertaining the facts, without apportioning blame, that being a role for the criminal courts. Amongst other vital witnesses to such an enquiry would be not only the McCanns and their friends who were together with them in Praia da Luz on that holiday, but also of course the various police officers who investigated the crime and assembled the evidence.

In this respect it is hard to know why the McCanns and their ‘Tapas 9’ friends would have any objection to a full public and judicial enquiry. They have constantly assured us that they are telling us the truth, the whole truth and nothing but the truth about what happened to Madeleine. Dr Kate McCann’s recent book, ‘madeleine’, also purports to be he truth, the whole truth and nothing but the truth.

The drawbacks of the ‘Scotland Yard Review’

By contrast, the ‘Scotland Yard Review’ that you have personally arranged has a number of apparent flaws and disadvantages, a number of which have been canvassed in the media and not least by members of the Metropolitan Police Authority.

The official Home Office announcement of the Review you have arranged said: “The Home Office today announced that the Metropolitan Police Service will be bringing their expertise to the case regarding the search for Madeleine McCann. A Home Office spokesperson said: ‘The government's primary concern has always been and remains the safe return of Madeleine. Although she disappeared in Portugal, and the Portuguese retain the lead responsibility in the case, law enforcement agencies here have continued to follow up leads and pass information to the Portuguese authorities as appropriate. The Prime Minister and the Home Secretary have today agreed with Sir Paul Stephenson that the Metropolitan Police will bring its particular expertise to this case. Clearly, the detail of what that will entail will be a matter of operational judgment and it would not be appropriate to discuss at this stage’.”

One prominent journalist immediately wrote: “The Prime Minister's decision to intervene in the case of Madeleine McCann could have political repercussions…the decision of Downing Street and the Home Office to effectively direct the Met Police to get involved is causing some unease. Some within Scotland Yard are uncomfortable at the way No.10 got involved - and now politicians are expressing worries too”.

As you will know, Lord Toby Harris of Haringey has raised major questions about how this decision was taken. He told the journalist: “It raises very big questions about political direction of the police. Presumably, if a Police and Crime Commissioner gave such an instruction it would be in contravention of the protocol published this weekby the Government?…what we are looking at is a case where the Met has no direct responsibility. There is clearly an issue about the resources being used and are they in effect saying that the Met is the default investigator for every case in the world involving a British citizen? It’s not just a question of direct costs, it’s a question of opportunity costs too. Our detective capacity is limited as it is”.

Lord Harris later wrote on his blog: “I imagine that the senior leadership of the Metropolitan Police are not exactly happy about this. It again embroils their officers in a high-profile investigation, where the chances of success are unclear, and which will divert limited investigative resources away from other matters. This is in response to an open letter in the Sun and is entirely predictable in terms of the ‘pulling power’ of News International on Government policy. The intervention drives a coach and horses through the draft protocol…It is a dangerous precedent for politicians to tell police what to do - and might not be a good use of time and money”.

The same journalist as above wrote: “The Met had been examining the case, but as recently as last week had largely ruled out any chance of making significant progress. The Home Office has agreed to meet the costs of the investigation but it appears only after the Met Police Authority and City Hall made clear it was unlikely to be able to approve the extra spending”.

The journalist then discussed whether you had ‘ordered’ or ‘requested’ this £3.5 million review: “The Prime Minister's official spokesman tried to draw a distinction between a ‘request’ from the Home Secretary and ‘political direction’ from the Home Secretary. ‘It was done, yes, at the request of the Home Secretary, but it has been agreed by the Metropolitan Police Commissioner. It's not direction, it's a request’, he said. ‘The Prime Minister has been very clear that he wants to do everything we can to support the family’.” Asked if the PM was simply following a tabloid agenda in the hope of good headlines, the spokesman said: ‘We are responding to a request from the family in a particularly exceptional case’.”

An article by Sandra Laville in The Guardian highlighted the extraordinary difficulties your proposed ‘Review’ would involve, including Scotland Yard waiting for all the documentation to be supplied by the Portuguese police, translating it, and then also reviewing all the Leicestershire Police documentation. She explained, accurately, that the whole process ‘could take years’.

Lord Harris’s criticisms were echoed by Liberal Democrat peer Lord Bradshaw, Vice-Chairman of Thames Valley Police Authority. He told Channel 4 News: “I am mightily worried about the politicisation of the police force. Although these appear on the face of them to be fairly innocuous orders, it’s a fairly short step from there to telling the police they have got to investigate this rather than that. It becomes a PR exercise. Chief Constables are desperately worried that their operational independence will be compromised”.

Shortly after the announcement of the ‘Scotland Yard Review’ and your involvement in promoting it, your official spokesman was quoted as saying: “The Prime Minister has been clear that he wants to do everything he can to support the family”. If this is the case, and if that is the main remit of Sir Paul Stephenson’s Review, then it would appear that the Scotland Yard detectives engaged on this ‘Review’ would effectively be banned from pursing, as part of their review, any line of enquiry in support of the hypothesis that Madeleine died in the McCanns’ apartment and that the McCanns then arranged to hide and/or dispose of her body. It would therefore not be the independent, ‘start from scratch and consider all the evidence’ review that it is being held out to be.

The McCanns’ appeal to you and your reply were published in the Sun newspaper, clearly by prior agreement. You said in your public letter to Dr Gerald and Dr Kate McCann: “Your ordeal is every parent’s worst nightmare and my heart goes out to you both”. Such an approach strongly suggests that you and the Home Secretary have requested Scotland Yard only to look at the possibility that Madeleine was abducted, not at the other possibility that Madeleine died in her parents’ holiday apartment.

Yet a police source for Scotland Yard said that in conducting reviews…“What we do is painstakingly look at all the evidence, the paperwork, the CCTV, any suspects who came to light and were investigated. Sometimes it takes fresh eyes to see what was always there”. As both Dr Gerald and Dr Kate McCann were suspects in the Portuguese and Leicestershire Police joint investigation that should presumably mean that the Portuguese Police’s suspicions of the McCanns hiding Madeleine’s body must be thoroughly investigated, along with everything else. Yet that would contradict your spokesman’s claims that you have arranged this review ‘to support the family’.

According to a newspaper report: “Cameron’s spokesman denied that he and May had been directing police on an operational matter. ‘It was done at the request of the Home Secretary. It was agreed by Sir Paul Stephenson. That is not a direction’” he said. We suggest, again with due respect, as do many observers, that the distinction between Sir Paul Stephenson ‘agreeing to a request’ by the Home Secretary and yourself to carry out a review, and being ‘directed’ to do so, is minimal and essentially academic. Moreover, it is clearly not a decision he would have reached without you and the Home Secretary promising him £3.5 million, which it is said will ‘cover the cost of man hours, flights to Portugal, hotels, consultation fees from forensic firms and many other expenses’, presumably money taken away from some other Home Office budget or even from some other Department’s budget.

It appears, then, that you and the Home Secretary have interfered with the traditional operational independence of the police and leaned on Sir Paul Stephenson to allocate potentially dozens of detectives to this review (some reports say ‘30’). Quite apart from the public expenditure coming from the taxpayer to fund this review, this means that those detectives, and the ancillary staff supporting them, will be unable to pursue the prevention, detection and prosecution of other forms of crime. In this regard, and of course with due respect, we believe that your arranging of this Review sets a very dangerous and wholly unwelcome precedent of political interference with police operations. Sir Paul Stephenson will be forced to drag these qualified and experienced detectives away from other work they are engaged on or could be engaged on.

Further, Lord Harris and Lord Beaumont are by no means the only public figures so far to have questioned what your decision means in terms of the operational independence of our police force, which has always been regarded as sacrosanct. Another fierce critic is Green Party Metropolitan Police Authority Member, Jenny Jones, who said: “The review is a ludicrous waste of money and will deny other victims of crime the chance of justice, while using up valuable police resources”.

The influence of Rupert Murdoch

We must also raise in particular, as many others have done, the undue influence of Rupert Murdoch in this particular case, as Lord Harris for example has touched on. It is well known that the Sun’s campaign on behalf of Labour in 1996 and 1997 was a major contributory factor to Labour winning the General Election of 1997. Indeed, Rupert Murdoch’s Sun famously boasted: ‘It was the Sun wot won it’. More recently, your own closeness to the Murdoch Empire has been noted. Many observed that the political attitude of the Sun switched from supporting Labour to supporting the Conservatives, after you met with Rupert Murdoch in 2009.

You also appointed ex-Murdoch man Andy Coulson, former Editor of the News of the World, to be your Director of Communications. And in March 2010 you appointed the McCanns’ chief public relations adviser, Clarence Mitchell, to be No. 2 to Andy Coulson in your General Election team. Andy Coulson was recently forced to resign as your Director of Communications because of his apparent association with the illegal ’phone tapping carried out by many of his staff, full details of which are yet to be revealed.

Along with allegations of ’phone tapping by Murdoch’s News of the World, there have been repeated and credible suggestions that senior Police Officers from the Met regularly supplied the News of the World and other media with confidential police information, contrary to their terms of contract. The close relationship between top Met Officers and the Murdoch Empire was exemplified by former top officer Andy Hayman moving to work for Murdoch almost immediately on leaving the Met.

Returning to Clarence Mitchell, it is clear that he has a close relationship with Murdoch and his newspapers. It is clearly relevant that in October 2008, when he began working for the McCanns on a part-time instead of a full-time basis, that he was immediately employed by Murdoch’s son-in-law, Matthew Freud, at Freud Communications. His ability to work both as Head of the 40-strong Labour government’s Media Monitoring Unit and then be employed by yourself suggests he is a person of major influence in top government circles. There remain major question marks as to why former Prime Minister Tony Blair considered it essential to despatch the Head of the government’s Media Monitoring Unit (Mitchell) to Portugal and of course about Gordon Brown’s interventions in the case.

Another indication of Mitchell’s close relationship with Murdoch is the number of times he has co-operated with both the Sun and the News of the World in promoting ‘exclusive’ stories about the McCanns in those newspapers. These stories have often been lacking in any serious evidential basis and were just media sensationalism.

I provide just one example: the Sun article of 1 September 2010. The basis of this was the claim that a notorious British paedophile, Raymond Hewlett, on his death-bed in a German hospital, had written a letter to his son, Wayne Hewlett, who hated him and from whom he had been estranged for over two decades. The letter had apparently been delivered by a ‘mystery man’, according to the Sun, and was said by Wayne Hewlett to contain an account of how his father had been drinking with a gypsy gang leader who was supposed to have admitted taking Madeleine McCann and arranging for her, for money, to be placed with a wealthy North African family. To cap it all, Wayne Hewlett said he had burnt the letter before going to the Sun with his story. The Sun’s promotion, with Clarence Mitchell’s help, of this clearly ridiculous story, casts doubt on the role of both the Sun and Clarence Mitchell in their promotion of such stories.

Added to the above, it is clear that the demands for this ‘Scotland Yard Review’ have been very much promoted by the Sun who published the McCanns’ letter to you and your reply simultaneously last Thursday.

Further, there was a disturbing article published in The Independent on 23 February this year by Cahal Milmo and Martin Hickman. Amongst other concerns, they noted that:

“Sir Paul Stephenson, Commissioner of the Metropolitan Police, dined privately with senior executives at the News of the World seven times over a four-year period, during which the force turned down calls for the heavily criticised investigation into phone hacking to be reopened. Following a demand that it disclosed its contacts with Rupert Murdoch's News International, Scotland Yard revealed that senior officers met News of the World editors 13 times between 2006 and 2010 in the aftermath of the arrest of a reporter for phone hacking. Almost half of the meetings were between Sir Paul, now Britain's most senior police officer, and an executive at the News of the World, Deputy Editor Neil Wallis. The Met…failed to investigate the full extent of the scandal. Dee Doocey, a Liberal Democrat Member of the Metropolitan Police Authority, branded the contacts ‘extraordinary’…She said: ‘Imagine the outcry there would be if the Commissioner was seen dining with a member of the public who was the subject of a police investigation’.”

Their report continued: “The closeness of the relationship between Scotland Yard and the News of the World has been repeatedly raised by critics of the original police inquiry into the activities of private investigator Glenn Mulcaire and royal editor Clive Goodman…Despite the discovery by detectives of 4,332 names, 2,978 mobile phone numbers and 91 PIN codes at Mulcaire's home, no-one was interviewed at the News of the World beyond Goodman…The Met said there was nothing unusual in senior officers dining with editors, but declined to detail meetings with other titles over the same period which would reveal if contact with the Sunday tabloid was unusually frequent. The meetings began with a dinner between Sir Paul and Mr Wallis in September 2006…They became more frequent in 2008 and 2009 with eight private dinners and social engagements, including an invitation for Sir Paul to attend the News Corporation summer party two years ago. Sir Paul also attended a private dinner that month with Mr Wallis, who was appointed Andy Coulson's deputy in 2003.

The Independent report continued: “In July 2009, John Yates, now Deputy Commissioner, refused to re-open the criminal investigation into hacking despite revelations by The Guardian that ‘thousands’ of mobile phones may been targeted and that more than £1m had been paid to settle cases out of court. Four months later, Mr Yates had dinner with the News of the World’s editor, Colin Myler. Ms Doocey said: ‘I find it quite extraordinary that when allegations about illegal phone hacking were still unresolved the Commissioner thought it was appropriate to be regularly dining with the News of the World and News Corporation’.”

The Guardian pointed out that the number of meetings between Sir Paul Stephenson and the News of the World editors did not include many other social contacts, for example, “After the Annual Bravery Awards…ten days after the Yard had elected not to reopen its inquiry into the phone hacking, Stephenson and Yates dined with Rebekah Brooks, former editor of the News of the World and the then editor of the Sun, which sponsored the awards.” Reference was also made to ‘many othermeetings and lunches shared between senior Met officers and former News of the World personnel who worked for the paper during the phone hacking investigation”.

Journalists have continued to cast doubt on the actions of the Met’s chief officers in relation to the ’phone hacking scandal, for example:

“There is now intense scrutiny of the police’s limited original investigation into the hacking affair, with claims of a cover-up. Although the Crown Prosecution Service (CPS) is reviewing all the evidence and will hold talks with Scotland Yard this week, there are demands for this investigation to be handed to a different police force or to the Inspectorate of Constabulary. Paul Farrelly, Labour member of the Commons Culture, Media and Sport Select Committee, said: “They cannot be judge and jury in their own actions. In the past, the CPS has just done a cut-and-paste of the Met Police’s press releases on this matter. We must inject some independence into the review of how the Met Police shut it down and the CPS decisions on that.”

There were further criticisms of your meeting with Rupert Murdoch’s son James at a time when Rupert Murdoch’s bid for complete ownership of BSkyB was being discussed, with continuing debate about the closeness of your relationship to Rupert Murdoch and his media outlets including his newspaper editors. Questions being asked included:

· Did James Murdoch authorise the payment of £700,000 to Gordon Taylor, the head of the footballers' union, after his phone was hacked? And if so, why?

· Why did News International pay private investigator Glenn Mulcaire £80,000, and also pay its former royal editor Clive Goodman, after they were both convicted of illegally intercepting phone messages and jailed?

· How many people have received payments from the News of the World, or its parent companies, after threatening to reveal evidence of its journalists' involvement in illegal phone hacking?

· Did James Murdoch or Rebekah Brooks discuss the proposed News Corporation purchase of BSkyB with David Cameron during their dinner together at her house over Christmas?

· Was Andy Coulson, or any other more senior News International executive, aware of Glenn Mulcaire's £2,000-a-week payment? What services did they suppose Mulcaire was providing for that pay?

On 15 February this year, The Guardian wrote: “A high court judge, Mr Justice Vos, has criticised the Metropolitan Police for failing to adequately investigate allegations of ’phone hacking by the News of the World’. He said: “The Metropolitan Police had not done an appropriate job in analysing phone-hacking...information in their possession. They didn't disclose highly relevant information. Scotland Yard had failed to fully comply with court orders requiring it to produce copies of Mulcaire’s notes relating to the two men”.

We also reproduce for interest some recent comments on the Spoked On-Line blog:

“Cameron’s Maddie venture undoubtedly confirms how powerful is the PR impulse in his government. On the very day that Kate and Gerry McCann wrote an open letter to his government on the front page of the Sun (12 May), in which they implored him to devote more resources to finding out what happened to Madeleine in Portugal in 2007, Cameron got his Home Secretary, Theresa May, to write to Scotland Yard asking its officers to ‘do more’…this is a government easily swayed by the vagaries of PR and image promotion. Cameron seems to have instantly seen in the McCanns’ letter, not a moment of potential awkwardness that might require behind-the-scenes diplomacy with the family, but a shining opportunity to advertise his alleged skills of political leadership and commitment to British citizens…This flags up the allegedly awesome power of Murdoch and/or the McCanns…”

A Guardian writer made this comment during the past few days: “David Cameron has surrendered to a newspaper belonging to News International, whose vast array of illegal hacking activities is already tying up some of our most diligent detectives”.

Is the Metropolitan Police the right Police Authority to carry out this Review?

In addition to all the above concerns, there are further matters that highlight the unsuitability of the Metropolitan Police to carry out this ‘Review’.

It would appear that the ‘Review’ into the Madeleine McCann case is to be under the overall leadership of Simon Foy, Head of Homicide and Serious Crime Command, with Detective Chief Superintendent Hamish Campbell as the Senior Investigating Officer and Detective Chief Inspector Andy Redwood as the lead Investigating Officer. One report said: “Britain’s top cold case cop is to lead the hunt for missing Midland girl Madeleine McCann. Detective Chief Inspector Andy Redwood of the Metropolitan Police is the sleuth who inspired Waking The Dead TV detective Peter Boyd, played by actor Trevor Eve”. The Sunday Mirror however clarified this, stating that Redwood was only in charge of ‘the day-to-day investigations’ and was not in overall charge.

In an article by Justin Penrose in the Sunday Mirror, 15 May this year, headed: ‘Madeleine McCann: Detective in charge of search for missing girl led investigation into Jill Dando's murder’, we were informed that: “The detective now in charge of the hunt for Madeleine McCann is the man who led the probe into the death of TV presenter Jill Dando. Chief Superintendent Hamish Campbell was head of the team that won the conviction of Barry George - later quashed on appeal…”

Can it be right to leave this Review into the disappearance of Madeleine McCann in the hands of the man who was in charge of one of the most incompetent investigations of recent years in the U.K., leading to the wrongful conviction of an innocent man, huge wasted public costs on an investigation that got the wrong man, and resulted in hefty compensation paid in respect of the wrongful conviction and imprisonment of Barry Bulsara? His record strongly suggests that he is just about the last man who should be entrusted with such a task.

As an example of the kinds of opinions about the case circulating close to the Metropolitan Police, we would respectfully ask you to note the opinions of Dai Davies, former Metropolitan Police Detective Superintendent, as set out in the Sunday Mirror on 23 September 2007. He wrote, inter alia:

“In my 38 years of police and private security work all over the world I've never known anything like the disappearance of Madeleine McCann…I spent a week in Praia da Luz where Madeleine went missing, ‘walking the shop floor’ as I call it, going over the available evidence and unearthing some startling new information about the case…I've discovered from lengthy talks with my barrister contact that Portuguese investigators have unofficially abandoned the hunt for Madeleine's alleged abductor. There is now NO detective work being carried out by Portuguese police to link anyone other than the McCanns to Maddie's disappearance. Officially, they say they're continuing the search for an abductor. But their policy is now to only respond to sightings reported to them by Europol and Interpol...They remain convinced of the guilt of Madeleine’s parents…even as their "house of cards" case collapses around them…The police now need to halt their campaign to pin this awful crime on two innocent people and bring in new officers for a complete overhaul with fresh eyes…”

As it happens, Mr Davies makes a number of inaccurate statements about the Portuguese Police in his article, but the essential question to be asked is whether officers with that sort of mindset could ever robustly and without fear or favour investigate the hypothesis that Madeleine died in her parents’ holiday apartment. If you have told the public via the Sun newspaper that the officers’ role is ‘to support the family’, can anyone realistically expect them to pursue the evidence against the McCanns?

Moreover, there has been a long and very unfortunate history of corruption and cover-ups in the Metropolitan Police. The book ‘Untouchables: Dirty Cops, Bent Justice and Racism in Scotland Yard’, by Michael Gillard and Laurie Flynn, reviewed a catalogue of corrupt activity in the Met, as did Graeme McLagan’s earlier book: ‘Bent Coppers’.

In an article by Hassan Mahamdallie a few years ago, titled ‘Metropolitan Police: a Long History of Corruption, Racism and Criminality’, he began: “The Morris inquiry is the latest in a series of investigations that should have exposed endemic…corruption in the Metropolitan Police…murders, armed robberies, drug dealing… pocketing millions in ‘dirty money’, high level cover-ups and the activities of the freemasons…”

During the Stephen Lawrence enquiry, for example, the authors said that: “During the Macpherson inquiry into Stephen’s murder, the Lawrence’s solicitors battled to make the links between corruption and racism. But they were blocked by the Met Police who were desperate to keep separate the question of police corruption in south-east London and the Lawrence murder. One Flying Squad officer who had investigated links between the Brinks Mat gang and police was prevented from giving evidence at the Lawrence inquiry. He said that this was done because “there are links between south east London criminal families and policemen, senior policemen, that go way back…and the Yard couldn’t afford for any of this to come out during the Lawrence inquiry”.

In recent years the conduct of senior Met Police Officers has been questioned in cases like the shooting of Jean Charles de Menezes and the unlawful killing of Gary Tomlinson at the recent G20 demonstration. In each case, senior Metropolitan Police Officers, including the former Met Police Commissioner, Sir Ian Blair, tried to cover their tracks and obscure what really happened. One other case amongst many has caused concern, namely the murder of Daniel Morgan in 1987. It took six Met Police enquiries before any headway was made, and that was only because Daniel Morgan’s family absolutely insisted that no Police Officer who was a Freemason could have anything to do with this sixth investigation, to which the Met reluctantly agreed. At last, this sixth enquiry produced charges against three men, two of them former Police Officers, but the Met’s conduct in the pre-trial stages ensured that the judges had no alternative but to halt the trial.

At the original Inquest into Daniel Morgan’s death, a Mr Kevin Lennon, an accountant, who knew both Daniel Morgan and his business partner, Jonathan Rees, said that Rees had planned to murder Rees, telling him: “My mates at Catford nick are going to arrange it. Those police officers are friends of mine and will either murder Danny themselves or will arrange it”. Justice has not yet been done in that case.

From the foregoing we strongly suggest that the Met Police is wholly unsuited to carry out this highly controversial ‘Review’.

Our requests

In the light of all of the above, we make these requests:

(1) That you call off the ‘Scotland Yard Review’

(2) That you set up a full, public and judicial inquiry, with a remit similar to that of an Inquest, and with the power to summon witnesses and require their attendance. The remit should be a full and fearless search for the truth about when and in what circumstances Madeleine disappeared, the truth about the activities of Brian Kennedy, his alleged intimidation of witnesses (please see our previous letters and his conduct of the McCanns’ private investigations, how the Find Madeleine Fund has dealt with funds received, most of them from the public, and how that money has been spent, the role of the government and in particular Clarence Mitchell and his role in producing spurious ‘sightings’ of Madeleine and arranging an array of (to date) no fewer than 18 assorted suspects and ‘persons of interest’, and all other matters relating in any way to Madeleine’s disappearance.

(3) That if you and the Home Secretary still consider that there should be a ‘Review’, that you find another Chief Constable who would agree to carry it out, not the met Police

(4) That you and Theresa May make it crystal clear to both the reviewing team and to the public that this ‘Review’, if it is to proceed, will be able to pursue the hypothesis that Madeleine McCann died in her parents’ holiday apartment and that the McCanns conspired to hide her body.

Finally, we have these Freedom of Information Act questions to which we would appreciate having answers within the next 20 working days:

1. Please specify on what dates you or your staff, in connection with the Madeleine McCann case, have either met, or had e-mail or telephone communication with all the following:

a) Dr Gerald McCann

b) Dr Kate McCann

c) Clarence Mitchell

d) any other adviser to the McCanns

e) Sir Paul Stephenson

f) any other officers of the Metropolitan Police

g) any members of the family of Rupert Murdoch

h) any staff of the Sun

i) any staff of the News of the World.

2. On what date did you agree with the Home Secretary and Sir Paul Stephenson that the Met Police (Scotland Yard) should carry out a review of the case costing £3.5 million?

3. On what date did you agree with the Editor of the Sun that they would simultaneously publish your letter in reply to the letter from Dr Gerald McCann?

FORMER Portuguese police co-ordinator Goncalo Amaral has issued a plea for Kate McCann to "tell the truth" and spoken of his delight at having his freedom of speech returned.

Speaking exclusively to mccannfiles.com on the eve of the publication of Mrs McCanns' book about missing daughter Madeleine, Mr Amaral said he was surprised at Kate's claim that she was writing her book "to give an account of the truth."

"It is strange to hear the word 'truth' from the mouth of someone who didn't cooperate with the police when the investigation was open," he said.

"And it was not any investigation; it was about finding what caused the mysterious disappearance of her daughter, and the enormous effort to recover her."

Mr Amaral believes the McCanns have "the right to be able to write what they like about the case" and supports the fact that Kate "is using her freedom of speech". Something recently denied him.

"A book that is written by someone who was a suspect may become of use as a document, maybe even a piece of documental evidence. Let us wait," he added.

Mr Amaral, whose bestselling book The Truth of the Lie was the subject of costly legal action by the McCanns, said he "felt like a free man" when the injunction on his book was overturned by the Appeals Court in October last year. "The McCanns also felt free because they decided to write a book," he observed.

The McCanns, who failed in their recent appeal to Portugal's Supreme Court to reimpose the ban, must now return all seized copies of the book, currently placed with their lawyer, Isabel Duarte, or risk incurring a criminal charge of disobedience.

"Legality has been re-established," said Goncalo Amaral. "The McCanns have just lost one more judicial action that was paid for with money from a fund that they say is for recovering their daughter.

"Both her and her husband were, and still are, more concerned with defending their image than in finding out what caused the child's mysterious disappearance."

An English language version of Goncalo Amaral's book is yet to be released but he said: "After the McCanns' book is published, there is no reason whatsoever for The Truth of the Lie not to be published in the UK. The British people are entitled to know all of the facts."

Mr Amaral believes that the process will be reopened and "the material truth will be known" and is dismissive of the McCanns' petition for a review of the case.

"That is one of the misunderstandings that are created by the McCanns," he said, "they do not want the case to be reviewed, they merely want a review of the information that has been added after the shelving (sightings of the child).

"If they wanted the case to be reviewed, they would ask for the crime process and the investigation to be reopened, and they would supply all of the reports from the various private detectives that they have hired.

"To ask for the process to be reopened, all it would take is a letter to the Prosecutor, as it has already happened in so many other cases. It costs them nothing, just the stamp on the letter."

If the process were reopened, Mr Amaral believes there are "several" diligences which could be carried out to help discover the truth.

"There will always be diligences that will result from reviewing the investigation and the reports from the McCanns' private detectives. Those diligences will have to take the conclusions that the Police had reached in September of 2007 into account.

"That is the starting point, but in the end it could happen that those conclusions are not confirmed. What is necessary is to complete an investigation that was suddenly interrupted due to the will of the parents of a child that has disappeared mysteriously."

Mr Amaral has no doubts about which action would have to be undertaken immediately to help unearth the truth of what happened to Madeleine.

"The first diligence, after the review, will have to be the reconstruction of that night of the 3rd of May, 2007."

Hundreds of '50 FACTS' leaflets were distributed this weekend in the Victoria Avenue area of Crewe, Swettenham village near Congleton, the Meadowhead Lane area of Rochdale, and the villages of Halkyn and Pentre Halkyn, Flintshire.

The Sun and Express articles were discussed. Most of the Sun article consists of self-serving, and disturbing, statements by Dr K McCann which are impossible to verify. Only one out of our 163 questions was even partially answered. The Express and Sun articles today were based on an artist's sketch which, so far as we know, has never been made public.

Further detailed investigations around the village of Halkyn revealed and confirmed that Arthur Cowley (whom we met) does not run any investigations group from there or anywhere else. We'll supply more info later.

Buying Kate McCann’s book won't help find Madeleine

With less than a week to go before the official release of Kate McCann's book, 'Madeleine', The Madeleine Foundation, which is sceptical about the McCanns' assumption that Madeleine was abducted, has warned the public that buying the book is unlikely to help to find Madeleine. The Committee has released the following statement:

"For a start, both Amazon and WH Smith have already cut the retail price of the book from £20 to just £10, meaning that the book is effectively selling for under £8. With the publishers and distributors needing to cover their costs, little will be left for the McCanns' 'Find Madeleine Fund'.

In addition, claims that the McCanns’ private investigation has been led by a couple of ex-detectives, Dave Edgar and Arthur Cowley of the 'Alpha Investigations Group' detective agency have been exposed as false in a new article on The Madeleine Foundation's website, published yesterday (5 May).

As our research shows, there is no such company. A company called ALPHAIG was however registered 6 weeks after the McCanns claimed that they had turned to 'Alpha Investigations Group' for help. This is solely owned by Arthur Cowley, its registered office is in Cowley's home, and the company's accounts reveal it has no employees and no assets. In other words, it is a sham company designed to create a false impression.

Moreover, despite spending millions of pounds of the public's money on investigators, the general public has not been given one single usable piece of information about the alleged abductor. Altogether, a total of 18 different artists' sketches have been given of 'suspects', 'persons of interest', and 'persons we wish to eliminate from our enquiries', two of them women. Even the McCanns' own website does not update its visitors on who they are really supposed to be looking for. Worse, a video in the McCanns’ site of a man in a yellow T-shirt looks nothing like the artist’s sketch of the ‘ugly, spotty, pock-marked man’, said to have been seen near the McCanns’ apartment the week they were in Praia da Luz.

Furthermore, the McCanns' private detectives, based in a house in Knutsford, Cheshire, purchased by multi-millionaire Brian Kennedy in 2007, have an appalling track record. The first company chosen, controversial Spanish detective agency Metodo 3, falsely promised that they had located Madeleine and that she would be 'home by Christmas' (2007).

The McCanns followed that by appointing fraudster Kevin Halligen, paying him a reputed £500,000 which he mostly spent on high living in the U.S. and Britain. Since October 2009 he has been in Belmarsh High Security Prison, fighting extradition to the U.S., where he is wanted on an alleged $2 million fraud. Another company, iJet, was paid by the McCanns in 2008 to field calls to its 'Investigation Hotline', but its Director publicly declared in 2009 that the McCanns had refused to follow up any of the public's calls to that 'phone line. A number of articles on our website examine in depth all aspects, many of them carefully hidden, of the McCanns' private investigation operation to date.

On top of all these considerations, the McCanns' current chief investigator, Dave Edgar, has made a variety of bizarre, contradictory claims about Madeleine's whereabouts which lack credibility, like:

* that Madeleine was seen walking behind a couple in Dubai

* that Madeleine was taken to Australia on a yacht by an Australian-speaking 'Victoria Beckham-lookalike'

* that an Angolan-born basketball-playing bouncer in Spain knows that Madeleine is in the U.S.

* that a letter from dying paedophile Raymond Hewlett which was then burnt by his estranged son Wayne Hewlett revealed the name of a gypsy gang leader whose gang had abducted Madeleine, and

* that he was 'convinced' that Madeleine was being held in a prison lair within10 miles of Praia da Luz, where the McCanns holidayed in 2007".

The Madeleine Foundation is currently inviting the public to sign an internet petition calling for a full public enquiry into all aspects of the disappearance of Madeleine McCann. Wey would like to see a judicial enquiry with the power to summon all relevant witnesses, including the McCanns and their friends, to give evidence on oath. We feel that such a public enquiry would be the best means of getting to the truth about what really happened to Madeleine.

After the successive debacles of the McCanns and Brian Kennedy appointing first the controversial Spanish detective agency Metodo 3 and then fraudster Kevin Halligen, supposedly to search for Madeleine, they then appointed local retired detective inspector Dave Edgar to ‘lead the hunt for Madeleine’ in November 2008.

Edgar was then based in the H.Q. of the private investigation office run by Brian Kennedy, a house in Knutsford bought by Kennedy for that purpose in the summer of 2007. Edgar did not at that time, nor has he since, either owned, part-owned or ‘run’ a company known as ‘Alpha Investigations Group’. His claim to do so is a sham.

In fact, one of Brian Kennedy’s right-hand men, Andrew Dickman, registered the domain name www.alphaig.co.uk on 12 January 2009, some four months before the McCann Team misled the media and the public into thinking that Dave Edgar ran a prestigious-sounding company called ‘Alpha Investigations Group’.

Despite much publicity and hype about Edgar’s ‘Alpha Investigations Group’ in May 2009, in fact the company being referred to was actually called ‘ALPHAIG’. It was not registered until after May - on 10 June 2009. Despite claims that Edgar, or Edgar and a colleague, Arthur Cowley, run ALPHAIG, it is a company wholly owned by Arthur Cowley. The registered address of the company, ‘Treetops’, in the remote Flintshire hamlet of Pant-y-Gof, is a property situated down a remote farm track and cul-de-sac, which may be unoccupied. ALPHAIG has no web presence, and does not give out any contact details. Its summary accounts, released in January this year, revealed inter alia that it had fixed assets worth just £630, hardly the kind of assets associated with a significant private investigations company.

Edgar’s main role over the past two years appears to have been to talk up as ‘strong leads’ claims - which are frankly bogus - that Madeleine may have been taken by a Victoria Beckham-lookalike on a yacht to Australia, may be held in a prison lair near Praia da Luz, may have been seen in Dubai, may have been taken to the U.S. as claimed by an Angolan basketball-playing bouncer, or may have been taken by an unnamed gypsy gang leader, details of whom were given by a dying paedophile in a German hospital to his long-estranged son, who in turn claims to have burnt that letter before proceeding to tell the Sun all about it.

The public have been told that they should buy Dr Kate McCann’s new book, due out on 12 May, in order to ‘continue the search for Madeleine’. Dr McCann has said that the book could ‘raise £1 million’, which she and the McCann Team say would pay for Dave Edgar and his ‘team of detectives’ to continue looking for Madeleine for a further two years.

On the evidence of this article, they would be wasting their money.

Today was the 1,442nd day since Madeleine McCann was reported missing by her parents. That’s 206 weeks, nearly 4 years.

Today was also a day when many members of the British public managed to find out a whole lot more facts about the case.

We have the Daily Mail to thank for that. For within a two-page feature article about Madeleine and the McCanns in today’s ediiton, the Mail informed its readers:

* about our organisation, and
* about our website, and
* about our letter to Transworld which suggested 163 questions that Dr Kate McCann should answer in her forthcoming book about the case, and
* about the leaflet we are distributing, known as ’50 FACTS’, which on four pages of A4 summarises some of the disturbing facts about the case.

The Mail, additionally, gave its readers the title of the leaflet: ‘What happened to Madeleine McCann? 50 facts about the case that the British media are not telling you’.

It even informed readers of the four main sections of the leaflet:

1) Major contradictions in the statements of the McCanns and their friends
2) The highly trained police dogs who detected the scent of a corpse
3) Strange things the McCanns have said and done, and
4) How the McCanns wasted public money on useless private detectives.

It also mentioned our first book on the case: “What Really Happened To Madeleine McCann? 60 Reasons To Suggest She Was Not Abducted”, now effectivley a banned book in view of the McCanns’ threat to sue for libel over its contents.

What has been the outcome of the Daily Mail’s article so far?

There were thousands of extra hits on our website; the final figures for the day are not in yet, at the time of writing this article
News of the publication and availability of the leaflet was circulated on Facebook, tweeted, and re-tweeted many times
A new blog about the disappearance of Madeleine McCann, “What happened to Madeleine McCann”, has received 4,200 new visits today so far
The leaflet was placed on the popular forum: ‘Complete Mystery of Madeleine McCann’. By this evening, over 1,500 had seen it there
The petition for a full public enquiry into Madeleine’s disappearance, sponsored by Madeleine Foundation member Alan-Marc Logoa, gained another 16 signatures, bringing the total to 584
The Mail article has been read by millions, many of whom sent comments to its online comments page. Many of these comments were critical of the McCanns, and these McCann-sceptic comments were voted up in their hundreds, using green arrows, by readers
Several people asked for supplies of the leaflet to distribute in their home areas
We received new orders for our latest book on the case: ‘The Madeleine McCann Case Files: Volume 1’, and
We received new enquiries about membership.

This response has echoes of a previous occasion when the media slated The Madeleine Foundation, following distribution of another leaflet about the case, ’10 Reasons’. The distribution of the leaflet to 150 houses in the McCanns’ home village, Rothley, led to adverse press headlines. But the Madeleine Foundation was named, and in the weeks that followed, tens of thousands visited our website, hundreds of our ‘60 Reasons’ book were sold, many more offered to distribute leaflets, and we gained 20 new members.

While the media may portray us as unjustified hounders of the McCanns, the fact is that many of the British public want to know more about the facts in this case, and are hungry for further information.

The reaction to today’s Mail article proves that once again.

Yesterday it emerged that the author had given a helping hand to Kate McCann, the mother of the missing eight-year-old, Madeleine, with her account of the disappearance in Portugal four years ago. But Rowling denied reports that she had written the book which is due to be published next month.

In a statement a spokesman for the author said: "While JK Rowling has been a long-term family supporter, her only part in bringing the book to publication has been in supporting the fact that her literary agent was also representing Kate. Beyond this, she has not been involved in any aspect of the writing, editing or publication of the book."

So in the lead-up to the publication of this 'very truthful' book about Madeleine, which will contain Dr McCanns' 'version of the truth', it looks like Dr Kate McCann (ahd her advisers and public relations officers) have been very untruthful.

The Daily Mail account yesterday had this:

"Rowling also helped Kate and husband Gerry by putting them in touch with her agent Christopher Little who arranged a book deal with publishers Transworld".

I think we can believe J K Rowling in this instance. I suspect the sequence of events was this:

1. McCanns to J K Rowling - 'We need a publisher for our very truthful account of what happened to Madeleine, can you advise?'

2. J K Rowling to McCanns - 'Try Bill Scott-Kerr at my publishers, Transworld'

3. McCanns to J K Rowling - 'We need a bit of help writing the book'

4. J K Rowling to McCanns - 'Sorry, too busy'

5. Meeting of McCanns and their publishes, advisers and public relations team - 'Bring J K Rowling into it to boost sales, advance orders are well below our predictions'

6. Clarence Mitchell briefs press: 'J K Rowling helped Kate write her book'.

7. Mirror headline: J K ROWLING'S MADDY BOOK

8. J K Rowling and her advisers: 'WT!?*!!??**?!*?!*' Put out a statement denying this immediately!!

ANOTHER LIE

But here's another lie.

In Sunday's Express, Dr Kate McCann said it was the 'fear of attacks by groups like The Madeleine Foundation' which had decided her against doing book-signings.

But in the Daily Mail the following day, we read this:

"Heartbroken mother will not take part in celebrity-style signings because it would be 'in bad taste'".

OK, 'very truthful' Kate, which is it?

Too frightened of attacks?

Or 'book signings would be in bad taste'?

Or is it even a third, unmentionable reason? That is - Because so few people would want to buy a book by people who deliberately left their three children in a dark room, 120 yards' walk away, whilst wining and dining wth their mates, yet produced an unnamed Social Services official who allegedly said: 'This is well within the bounds of responsible parenting?

All of this after TWO of the their three children, only the previous night, had said: "Why weren't you here when we were crying last night?"

Great Ormond Street cardiologist is suspended over allegations of child abuse

A surgeon at Great Ormond Street Hospital is being investigated over claims of child abuse.
The allegations against Philipp Bonhoeffer, a world-renowned cardiologist, relate to his time working for a charity in Africa.
He was suspended two years ago but the case has only just come to light. The hospital has set up a helpline for parents of children he has treated.
Four families had contacted the helpline by last night.
The 49-year-old, who was born in Germany, began working at the famous London children’s hospital in 2001 and has treated hundreds of young patients as head of cardiology.
He had been due before a General Medical Council tribunal in October but the case was halted after his lawyers submitted that there was not enough evidence.
This objection will be heard at the High Court today – but the GMC insists its investigation will go ahead regardless.
Although details of the case have not been made public, it is believed to concern a man who alleges he was sexually abused by the doctor when he was a child.
Dr Bonhoeffer is also alleged to have tried to bribe the man to make him retract his accusations.
The doctor, who lives in Camden, North London, strongly denies all charges made against him.

Spot the difference:

Glenfield Hospital cardiologist, Gerry McCann, on the other hand, was NOT suspended from his job for repeated negligence of his three young children which led to one of them being believed to have met her death in the apartment whilst left alone. Dr McCann is also suspected of having concealed the body of his daughter to allow him to set up a Fund which has attracted millions of pounds, some of which was used to pay his mortgage.

Instead of being suspended, Dr Gerry McCann was permitted to make use of Glenfield Hospital to take part in a documentary for Channel 4 (Cutting Edge Madeleine was here).

re: Fitness to Practise: Dr Gerald McCann and Dr Kate McCann (formerly Dr Kate Healy)

I write to bring to your attention a report about the above couple, both doctors, published in the Sunday People yesterday.

Dr Gerald McCann and Dr Kate McCann are the parents of Madeleine McCann, who was reported missing by her mother at around 10.00pm on Thursday 3 May 2007. The circumstances of her disappearance remain mysterious and as yet unsolved. They were made official suspects of involvement in their daughter’s disappearance in September 2007, a status that lasted until July 2008 when the Portuguese judicial authorities concluded that at that time there was insufficient evidence to charge them or anyone else with a crime against Madeleine.

Yesterday, the Sunday People published an article based on what they said was a 34-page libel writ served in Portugal against Goncalo Amaral. The McCanns and their advisers have already announced in the press that they intended to sue Mr Amaral for libel. Mr Amaral was the senior investigating officer in the case until he was removed from the investigation in controversial circumstances in October 2007. A month earlier, he was the man responsible for declaring the McCanns to be official suspects in their daughter’s disappearance.

The Sunday People says it has translated the libel writ from the Portuguese. The McCanns are claiming damages of £1 million from Mr Amaral. I wish to bring to your attention the medical and psychological condition of these two doctors, one of whom continues to practise, and both of whom we understand to be on the GMC Register.

The writ says of Dr Kate McCann that she is ‘deeply and seriously depressed”. The writ goes on to describe both of the McCanns as suffering from:

· permanent anxiety,
· insomnia,
· lack of appetite,
· irritability,
· indefinable fear.

In the writ, according to the Sunday People, the McCanns further describe both of themselves as:

· “totally destroyed”,
· “irreparably damaged”, and
· “totally destroyed from a moral, social, ethical, emotional and family point of view”.

The question that arises is whether either of these doctors is fit to practise or indeed to remain on the GMC Register, at least until these serious psychological problems, suggestive of mental illness, subside. We suggest that the appropriate committee of the GMC should consider (a) suspending them from the GMC until a psychiatrist deems that they have recovered from the above symptoms and (b) providing them with the expert psychiatric help and counselling that anyone exhibiting such severe symptoms should receive from the N.H.S. Presumably if the McCanns are exhibiting these symptoms there are reports available from their G.P. or a psychiatric specialist confirming those symptoms.

The other possibility of course, is that the McCanns are grossly exaggerating the extent of their depression or even lying about it, in order to make as much money as possible from Mr Amaral. If that were the case, there would definitely be a whole series of other questions about their fitness to remain in practice and remain on the GMC Register. Many videos and still images exist of the McCanns laughing and joking and appearing to be anything but severely depressed. That would suggest at least the possibility that they have deliberately exaggerated their sadness at and reaction to the loss of Madeleine in order to make as much money as possible from their proposed libel action...

MADELEINE McCann’s parents are set to be quizzed in court later this year in connection with their daughter’s disappearance.

Kate and Gerry McCann, of Rothley, Leics, will face lawyers acting on behalf of the Portuguese detective who led the hunt for Madeleine.

They are suing former police chief Goncalo Amaral for more than £1million damages over claims he made about them.

Amaral, who believes Madeleine is dead, is due to call the McCanns in his bid to defend himself.

Last night the couple’s lawyer Isabel Duarte said she expects the libel trial to take place this year.

She said: “It could be June or July but most likely September. He can call them if there are things they can contribute (to his case).”

Madeleine went missing during a family holiday in Praia da Luz, Portugal, in May 2007.
